We managed to obtain a write-off of claims for all liabilities in the bankruptcy procedure of an individual, case No. 911/2659/23.

In the summer of 2023, we signed an agreement with a client (military serviceman) on the provision of legal services to resolve issues with problematic debt in microfinance organizations. The main goal was to get rid of debts, as well as from constant calls.

The debt amounted to UAH 457,500.11. according to the credit history and the ultimate goal of the client was to write off the debt in full and restore the credit history.

To do this, we collected all the necessary documents, prepared a statement with all attachments and sent it to the court. After the opening of proceedings in the case of bankruptcy of an individual, we supported all procedural actions and documentation, as well as administered the process of working with the arbitration manager.

All creditors were notified of the initiation of the case, but during the 120 days of the first stage of the trial, the creditors did not file their claims with the court, even after receiving an official letter from the receiver. Therefore, the court set the date of the final meeting, at which the court decided to close the proceedings in the case, all the creditors’ claims were recognized as extinguished, and the executive documents for these claims were recognized as unenforceable.

In addition, the court decision dated January 17, 2024 granted our application for a partial return to the client of the funds advanced to the arbitration administrator in the amount of UAH 6,434.52, because the period of his performance of his powers was less than 120 days.

In the final result, after fruitful work, we achieved all the set goals and received the desired result in the form of a complete write-off of the client’s credit debts. Now the client is satisfied and debt-free!
