Case: The client’s bank account, which was blocked due to the opening of enforcement proceedings, was unblocked

Reading time: 2 min.

Service: Unblocking Accounts of Bank and MFI Debtors

In modern conditions, a blocked bank card (account) is not just a legal issue, but a complete shutdown of a person’s financial life. Our client found herself in a situation where, due to an open enforcement proceeding, she lost access to her own funds, as the bank blocked her account in connection with the opening of enforcement proceedings.

Problem: complete bank ban

The client learned about the account seizure unexpectedly. The enforcement service imposed an arrest on the entire amount on the card, depriving the woman of the ability to buy food, pay utility bills, and make any payments.

According to the law, during the period of martial law, a debtor has the right to spend from an arrested account an amount equal to two minimum wages per month. However, in order to activate this right, one must go through a bureaucratic circle of hell.

What the client would have had to do if she acted on her own

  1. Independently find the enforcement officer’s contact details (which often do not answer calls).
  2. Properly prepare an application for determining a current account for carrying out expenditure transactions.
  3. Submit the application and monitor its consideration.
  4. Communicate with the bank so that the resolution is not just “accepted” but actually implemented.

Solution from the law firm “Prikhodko & Partners”

We took over the entire process “turnkey”. The client did not have to waste time on queues and formalities.

Our actions:

  • Immediate response: We promptly prepared an адвокатський request to the enforcement service.
  • Professional communication: Our lawyers directly contacted the private enforcement officer to speed up the process.
  • Execution control: We accompanied the case until the bank received the resolution and unblocked the limit.

Result

The client received a Resolution on determining a current bank account for carrying out expenditure transactions. She can now freely use an amount equal to two minimum wages (currently UAH 16,000) per month, despite the existence of enforcement proceedings.
