Service: Removal of encumbrance from movable property

In May 2025, our law firm was contacted by a client named Volodymyr with a problem related to the inability to sell a car through the Diya application. The system reported the need to contact the enforcement service due to the presence of an encumbrance. Our team promptly took up the issue, and the case was successfully completed with a positive result for the client.

Analysis of the situation regarding the removal of encumbrance from a car

After the client’s application, we analyzed the situation and found out that the car was encumbered due to an unpaid debt that was in enforcement proceedings. The enforcement proceedings were closed and sent to the archive, but the debt for payment of enforcement costs remained unpaid, which blocked the possibility of selling the car.

Process progress

  1. Contact with the enforcement service
    We promptly contacted the enforcement agent, who informed us that the case had been transferred to the archive due to the expiration of the statute of limitations, but the debt for payment of enforcement costs in the amount of UAH 1,048.00 remained unpaid.
  2. Return of the case from the archive and repayment of the debt
    Our team agreed with the enforcement service to return the case from the archive for its re-examination. After that, we organized the payment of the debt by the client in full, which allowed us to move on.
  3. Completion of enforcement proceedings
    After repayment of the debt, the enforcement agent officially completed the enforcement proceedings and sent a corresponding notification to the Main Service Center of the Ministry of Internal Affairs.
  4. Removal of encumbrance and sale of the car
    The Main Service Center promptly removed the encumbrance from the client’s car. Immediately after that, Volodymyr was able to successfully sell his car through Diya without any additional obstacles.
