Everyone knows that title documents must be provided for each newly constructed real estate object. But it happens that a house is built first, and only then does its owner think about the necessary documentation. This happens, for example, when you need to turn on communications to the home, or register in it. If there are no legal documents, then it is impossible to do this. And what then?

Today, the so-called "construction amnesty" operates in Ukraine.

Construction amnesty is the possibility of commissioning a building without permits for the start of construction, i.e. without a construction passport and notice of the start of construction work.

To which objects can construction amnesty be applied?

To objects that have an insignificant class of danger (responsibility). Conventionally speaking, if a small house with one floor was built, then it can be legalized according to a simplified procedure, but if it is an apartment building - then not.

This is a real estate object that was built between August 1992 and April 2015, or if it is a commercial building that was built before March 2011.

The built real estate object is located on a plot of land for the appropriate purpose. That is, if the house is built on a plot of land intended for the construction and maintenance of the house, it falls under the construction amnesty. But if such a house, for example, is built on a plot of land for gardening, then it does not fall under the simplified commissioning procedure.

The application for putting the house into operation must be submitted exclusively by the owner or user of the land plot on which the house is built.

Are the documents necessary for the application of construction amnesty?

  • Statement on the possibility of taking the real estate object into operation.
  • A completed declaration on the facility's readiness for operation.
  • Report on technical inspection.
  • Duly certified copies of documents confirming ownership of the land plot on which the house is located and the technical passport.

Review period

Within 10 days from the submission of a complete package of documents on putting the building into operation, a decision is issued to accept the object into operation

Fines

If the building is put into operation using construction amnesty, fines for spontaneous construction are not applied.
