What is the liability for drug possession (Article 307 of the Criminal Code of Ukraine)?

The Criminal Code of Ukraine includes about 20 articles related to such a crime as illegal drug dealing. These articles define punishments for various types of crimes. In the practice of lawyers, Articles 307 and 309 of the Criminal Code of Ukraine are the most common.

According to Article 307 of the Criminal Code of Ukraine, the maximum penalty for drug possession is imprisonment for up to 8 years. If the possession of drugs is not related to the desire to earn money, the following punishment options are possible:

• Performance of socially significant works.
• Imprisonment for up to 3 years.
• Arrest for up to 6 months.

Important: if the volume of the seized narcotic substance does not exceed 0.005 g, an administrative, not a criminal, penalty follows.

Administrative responsibility arises for the illegal cultivation of hemp or marijuana in the amount of up to 10 plants. It is provided for by Article 1062 of the Code of Ukraine on Administrative Offenses. Thus, in each specific case, a violation of the law under Article 307 of the Criminal Code of Ukraine can be interpreted differently.
