The legal framework governing military registration and mobilization issues changes regularly. Such transformations are usually associated with the need to replenish the army. One of the significant legislative changes occurred on May 4, 2024, when the status of "limited fitness for military service" was abolished in Ukraine. Accordingly, all those conscripts who previously had this status must undergo a repeated medical examination at the military medical commission (MMC). This is necessary in order to determine the current state of health and the degree of fitness for service in accordance with the new classifications.

If you are interested in a consultation on the topic of MMC for the partially fit or legal support for this procedure, you can contact the specialists of the Prikhodko & Partners law firm and order the relevant services. Military law is the focus of our practice, so we regularly support such client cases.

What should you know about the repeat military medical commission?

Re-passing the MMC for those who were found to be of limited fitness is mandatory. Conscripts who had this status before May 4, 2024, must undergo a medical examination again to clarify their fitness for military service.

If we analyze the news of the legal field on this topic, we can see that parliamentarians have legislatively secured the extension of the deadline for passing the MMC in such cases. This should be done before June 5, 2025. Therefore, there is still some time. However, the procedure should not be postponed, because by the end of this period, obviously, there may be long queues at the TCC from those people who will try to pass the MMC at the last moment.

Why should you not ignore legal requirements?

Being frightened by many examples of force mobilization, a significant number of conscripts do not show up at the TCC to undergo a repeated MMC. Moreover, there are many cases when a person is really considered healthier during the examination than he actually is, without taking into account his current diagnoses.

However, even taking these factors into account, ignoring the legal requirements is not a solution. Otherwise, you expose yourself to the risk of facing penalties. When a conscript fails to undergo the MMC within the established time frame, this threatens him with a fine of 17 to 25.5 thousand hryvnia. Such sanctions are formally possible now, but a certain political consensus has been reached regarding their non-application to those who have not had time to undergo the MMC as of today. Therefore, this issue should be resolved by June 5, 2025.

Another reason why you should not delay undergoing a MMC is that no one is immune from meeting representatives of the TCC right on the street. In this case, the risk of force mobilization without attention to existing diagnoses is really high. A more constructive solution would be to undergo an examination by a military medical commission accompanied by a lawyer. This will minimize a number of risks.

What is the procedure for passing the military medical commission?

To undergo the MMC, military personnel must contact the territorial recruitment and social support centers (TRC and SS) at their place of registration. Authorized TRC persons will issue such a person a referral to the MMC. If you do not wait for a summons, but initiate the process yourself, this will allow you to avoid possible sanctions and do everything so that the result of passing the MMC is truly objective. Legal support for the procedure will facilitate this.

Due to possible changes in legislation and the timing of the MMC, it is important to monitor official announcements from the Ministry of Defense and other government agencies. If you have any doubts, consult with professionals specializing in military law.
