Many people mistakenly believe that having the status of “wanted” automatically makes it impossible to obtain a deferment. In reality, this is not always the case, as the right to deferment is determined by the existence of legal grounds, not by the mere fact of being entered into the “Oberig” database. Specialists of Law Firm Prikhodko and Partners will explain how to obtain a deferment while having a red mark and what steps to take next.
Does wanted status affect deferment?
The mere fact of violating military registration rules does not mean an automatic loss of deferment rights. If a person has lawful grounds for deferment, they remain valid regardless of such records. The maximum consequence in such a case may be administrative liability in the form of a fine.
At the same time, when applying for deferment through the “Reserve+” application, such records usually do not prevent the submission of an application.
How to obtain a deferment from mobilization if there is a red mark in Reserve+?
Currently, there are two main methods:
| Method | Features |
| Through the “Reserve+” application | Submitting an application online without visiting the TCC. Data is automatically verified through state registries. |
| Through the Administrative Services Center (CNAP) | A person submits an application and a package of documents to the CNAP administrator, after which the documents are forwarded to the TCC for verification. |
Online processing through “Reserve+” is available for many categories of persons liable for military service, including students, postgraduate students, doctoral candidates, persons with disabilities, parents with many children, and other persons whose data may be automatically retrieved from state registries. In most cases, it is sufficient to submit an application through the app, after which the system automatically verifies the information and grants the deferment. Its extension is also carried out automatically in the future.
If the process takes place through CNAP, the procedure is as follows:
- An application is prepared and supporting documents are collected
- The documents are submitted to the CNAP administrator
- CNAP transfers the materials to the TCC and SP
- The TCC verifies the legality of the grounds for deferment
- If approved, the deferment is displayed in “Reserve+”; if denied, a notification is sent by email
- If necessary, the CNAP administrator may also print the refusal decision.
If a person is still concerned about having the “wanted” status, they have the right to acknowledge the administrative offense and pay the fine. At the same time, payment does not guarantee that the wanted record will not reappear in the future for another period or due to new violations of military registration rules.
How to remove TCC wanted status remotely?
One of the most common methods of remotely removing the red mark in Reserve+ is paying the fine through the application.
Another option is to contact a military lawyer, who can determine the reasons for entering a person into the “Oberig” registry, analyze the legality of the TCC’s actions, and send a lawyer’s request or demand to cancel the unlawful wanted status.
It is also possible to challenge the TCC’s decision in court. In such cases, it is important to properly prepare a legal position, collect evidence, and substantiate your arguments, which is why the assistance of a military lawyer is more important than ever.
What is required at CNAP to obtain a deferment?
To obtain a deferment through the Administrative Services Center, a person liable for military service must personally submit an application and a package of documents confirming the right to deferment. Submission through a representative, even under a power of attorney, is currently not permitted.
As a person liable for military service, you must have with you the originals of your passport, identification code, documents confirming deferment, as well as copies of these documents. The list of documents depends on the specific grounds — education, disability, caregiving, having many children, etc.
After accepting the application, the CNAP administrator issues a description of the submitted documents — this confirms the fact of submission. It is also important to remember that the applicant is responsible for the accuracy of the submitted data.
What does it mean if the TCC is looking for you while you have a deferment?
Having a deferment does not release a person liable for military service from fulfilling other military registration obligations. In particular, the person must still update military registration data, appear upon summons, undergo a military medical commission in cases предусмотрених by law, and comply with other requirements of the TCC and SP.
That is why even with a valid deferment, a “wanted” record may appear in the registry if the person failed to fulfill one of the obligations listed above.
In such a situation, the best option is to clarify the reason for being entered into the registry. This can be done by personally contacting the TCC or through a lawyer who will verify the legality of entering the person into the “Oberig” registry. Often, records may be erroneous or added automatically.
How to obtain reservation status if you are wanted?
If a person liable for military service has a red mark, the possibility of obtaining reservation status depends on the type of company where they work.
For employees of defense-sector enterprises, legislation provides a special mechanism — obtaining a reservation for up to 45 days. This period is granted so that the employee can resolve military registration issues: update data, complete the necessary procedures, pay a fine if needed, or remove an unlawful wanted status.
For other businesses, even critical enterprises, in practice there is a rule that the person must be “clear” in terms of military registration. That is, before obtaining reservation status, the wanted record must be removed, and only after that the employer can submit the employee for deferment.
As an option, you may pay the fine, the wanted status will be removed, and during this time apply for reservation status, although this does not always work in practice.

Does the search affect the postponement?
No, the “wanted” status itself does not deprive you of the right to a deferment from mobilization, if you have legal grounds for receiving it.
How to apply for a deferral if you are not registered?
First, you need to contact the CCC and register for military service, being sure to provide documents confirming the right to a deferral. After that, you can submit an application through the Central Service Center or “Reserve+”.
Who can automatically receive a deferral?
Automatic extension of the deferment applies to certain categories of military conscripts if the grounds for the deferment have not changed and the data is confirmed through state registers.
How does the response about the postponement come?
Most often, information about granting and extending a deferral is automatically displayed in the “Reserve+” application.
What should I do if I paid the fine and the wanted person has not disappeared?
If the status does not disappear, it may be a technical error or there may be another reason for the search, so it is worth contacting a lawyer or the CCC to verify the information.
