Apply to the European Court of Human Rights against Russia

Reading time: 3 min.

The European Court of Human Rights (European Court of Human Rights) is an international judicial body whose jurisdiction extends to all member states of the Council of Europe that have ratified the Convention on the Protection of Human Rights and Fundamental Freedoms.

In particular, Ukraine is among the countries that have ratified the Convention on the Protection of Human Rights and Fundamental Freedoms, and therefore citizens of Ukraine have the right to file a complaint with the European Court of Human Rights (ECHR).

Russia (RF) also ratified the relevant convention.

And therefore, citizens of any country that ratified the Convention on the Protection of Human Rights and Fundamental Freedoms had the right to file a complaint against the actions of Russia (Russia) to the ECHR.

Why "have" and not have the right?

In connection with the large-scale invasion of Russian troops on the territory of Ukraine, the Council of Europe decided to exclude Russia (Russia) from the Council of Europe, which in turn resulted in the withdrawal of Russia (Russia) from the Convention on the Protection of Human Rights and Fundamental Freedoms.

And therefore, on September 16, 2022, Russia (RF) finally withdrew from the Convention on the Protection of Human Rights and Fundamental Freedoms.

What to do if your rights and freedoms were violated by the military aggression of Russia (Russia), but you did not have time to file a complaint against the actions of the aggressor country to the ECHR?

Judge of the ECtHR from Ukraine Mykola Hnatovskyi commented on Russia's withdrawal from the Convention on the Protection of Human Rights and Fundamental Freedoms:

"The Court retains the competence to consider statements against the Russian Federation regarding its actions or inactions that may constitute a violation of the Convention, provided that they occurred before September 16, 2022".

That is, if your rights and freedoms were violated by Russia (Russian Federation) before the day this country withdraws from the Convention on the Protection of Human Rights and Fundamental Freedoms, namely until September 16, 2022, then YOU HAVE THE RIGHT TO SUBMIT A COMPLAINT AGAINST THE ACTIONS OF RUSSIA (RF) TO ECtHR

However, now another question arises, how to file a complaint against the actions of Russia (Russia) to the ECtHR, if you missed the deadline for filing a complaint, which is four months?

Despite this, do you want to receive a letter from the ECHR Secretariat with the following content?

"The Secretariat has received your appeal. Your application has been assigned the above number, which must be mentioned in all subsequent letters regarding this application', which in turn means that your case will be considered by the ECtHR.

The lawyers of the company "Prykhodko and Partners" will help you in this, who will bring your case to the final positive decision of the ECtHR in your case against the aggressor country Russia (Russia) for the damage caused to you and your loved ones.
