Applying for a pension while a person is abroad is a fairly common request that is often addressed to pension law specialists. If you need qualified advice or legal support, you can order these services from specialists who specialize in this area of law and work in the team of the law firm "Prikhodko and Partners". We know how to really help you effectively. Let's consider in more detail what the legal regulation of this issue is.

How can you apply for a pension?

How to apply for a pension if a person is abroad?

You can submit an application for a pension in several ways:

  • by mail;
  • electronically through the official web portal of electronic services of the Pension Fund of Ukraine (pensioner's electronic account);
  • via the Unified State Web Portal of Electronic Services (DIYA portal).

In addition to documents confirming age and length of service, persons temporarily residing abroad (except for persons residing in the territory of a state recognized by the Verkhovna Rada of Ukraine as an aggressor state) must attach copies of the necessary documents to the application for a pension. This includes documents on obtaining temporary protection or refugee status and registration of their place of temporary residence or stay abroad (with translation). Such documentation must be certified by a diplomatic mission or consular office of Ukraine or notarized.

It is worth knowing that annual physical identification is mandatory for Ukrainians living abroad. It must be completed every year by December 31, and if this is not done, pension payments may be terminated.

Also important: if your place of registration on the date of filing an application for a pension is a temporarily occupied territory, you must carefully submit the application and additionally indicate that you do not have Russian citizenship. In addition, it is important to indicate that you were not on a pension scheme and did not receive payments from the Russian Federation.

What to do if there is a problem with the registration of a pension?

Often, pensioners face artificial complications in the process of applying for a pension. This is the reason why there is a need to contact pension lawyers who are able to qualitatively influence the resolution of such a situation. If you have also encountered a similar problem, then you have come to the right place. Specialists working at the law firm "Prykhodko and Partners" know how to help their clients.

As our practice shows, a problem with the appointment of a pension can arise for very different reasons. For example, this is:

  • inaccuracy of entries in the work book;
  • periods of work abroad and the reluctance of PFU employees to understand how the length of service in a particular country is credited in accordance with international agreements to which Ukraine is a party;
  • the presence of periods of preferential service, which allows for early retirement (in particular, according to List No. 1 and List No. 2) and which PFU representatives often do not want to credit (for example, referring to certain problems with job certification).

The above are not all the problems that are used by authorized officials of the Pension Fund to deny the right to a pension. However, in most such cases, the obstacles are artificial, and the pensioner really has the right to claim proper pension benefits. Therefore, the first thing a qualified lawyer does when faced with such a client request is to analyze the reason for the refusal to assign a pension. And only after carefully analyzing all the circumstances of the case, one can understand where to move next in order to truly effectively appeal the actions of the Pension Fund and help the client with the registration of a pension.
