Who keeps military accounting at the enterprise?

The organization of accounting in the company is entrusted to the manager, but direct management is carried out by relevant employees - the personnel service / personnel management. If there is no separate personnel department, the responsibilities are assigned to the person who keeps personnel accounting of employees.

Requirements for military accounting

A business must ensure systematic and continuous maintenance of military accounting in accordance with the rules. First of all, this includes:

  • appointment of a responsible person
  • maintenance of accounting documentation
  • regular interaction with the TCC and the SP.

The responsible person must constantly maintain a personal list and update data in a timely manner (in particular, on acceptance, dismissal or change of accounting information - within 5 days). When hiring, the CVs must be checked and copies of them are attached, and employees are familiarized with the rules of military accounting for signature.

Special attention should be paid to keeping a log of inspections and monitoring compliance with the rules. The company must also annually reconcile information with the TCC and the SP, draw up relevant acts and submit them within the specified deadlines.

In addition, the employer must ensure the relevance of employee personal cards, submit the necessary reporting and facilitate the implementation of mobilization measures.

What documents does the TCC check at the enterprise?

During inspections, the military registration and enlistment office analyzes the state of military accounting in detail, including both organizational documents and the actual state of accounting data, in particular:

Regulatory documents

  • order on the appointment of a responsible person;
  • orders on the organization of accounting;
  • documents on determining the need for improving the qualifications of the responsible person.

Confirmation of the qualifications of responsible persons

  • certificates of training;
  • training planning (if necessary).

Accounting documentation

  • lists of personal military accounting;
  • operational accounting information;
  • employee personal cards with marks on military accounting;
  • copies of the military registration certificate.

Analysis of case law shows that fines for violating military registration rules are not automatic - courts carefully check the presence of guilt and compliance with procedures on the part of the TCC and the SP.

In most cases, the courts side with enterprises if:

  • the obligation for the violation of which the fine was imposed was not yet in force at the time of the incident (as in case No. 308/18659/24);
  • the responsible person is incorrectly identified (for example, the fine was not imposed on the manager or not on the actually responsible employee - case No. 185/6974/23);
  • the enterprise can confirm that it has taken all possible measures to comply with the requirements of the law (case No. 352/133/26).

Separately, the courts emphasize that the employer is obliged to organize military registration and notification of employees, but does not have the authority to use coercion to force them to appear at the TCC. At the same time, there should be documentary confirmation of all actions - notifications, verifications, data updates, and explanatory work.

What document confirms the right to conduct a military registration check?

The basis for the inspection of military records is an order for the inspection issued by the authorized body. It must be properly executed and, if available, certified by a seal.
