Legal assessment under Article 187 of Ukraine’s Criminal Code

Article 187 concerns an attack aimed at taking another’s property, accompanied by violence dangerous to life or health or a threat of such violence. Each element needs review rather than assuming the classification from a conflict or injury alone. The distinction from open theft, extortion or another offence depends on the facts established.

A group episode requires assessment of the individual role, intent and contribution. Being nearby does not replace proof of participation, and a general statement that people acted together does not explain every act. Preparation, method, interaction and any additional qualifying features are examined against the underlying records.

Evidence and circumstances the lawyer examines

We compare recordings, testimony, medical records, expert findings and information about items associated with the attack. The assessment of violence includes method, circumstances and causation, not simply the injury description. A colloquial assessment of danger or a word in a medical certificate cannot substitute for legal analysis.

Initial reports, the description of the attacker, identification and observation conditions are reviewed. An injury, discovered item or contact is considered with the other evidence and lawful provenance. A victim’s treatment, property loss and claimed harm should be documented without mixing different demands or periods.

  • The notice of suspicion and procedural records.
  • Recordings and initial incident reports.
  • Medical documents and expert findings.
  • Identification and seizure materials.
  • Property and loss records.
  • Court orders and upcoming action details.

Legal assistance during investigation and in court

Urgent assistance may include counsel after detention and preparation for questioning or a preventive-measure hearing. We review the record, suspicion and available evidence and identify what the next action requires. Attendance and location are agreed for the actual situation.

Continuing defence may involve motions, expert questions, objections and the trial position. A victim’s engagement can cover representation and compensation issues; an accused person’s defence is different. Assistance is arranged without conflicts or promises of a particular sentence or recovery.

Stages of working with a lawyer

Lawyer consultation concerning violent robbery

A consultation concerning violent robbery starts with your procedural status, the records received and the next scheduled date. We distinguish issues that can already be assessed from those requiring additional case materials.

For a meaningful review under Article 187, provide available records such as the notice of suspicion and procedural records and recordings and initial incident reports in advance where possible. Do not select only favourable extracts: inconsistencies matter when assessing risks. We explain the available procedural steps, documents needed and limits of the proposed assignment. A consultation, a single submission and continuing case representation are different engagements.

An online consultation concerning violent robbery can provide an initial review remotely. Communication and file-sharing arrangements are agreed with counsel. Personal attendance at an investigative action or hearing is arranged separately according to the procedure and location. Sending an enquiry does not automatically appoint a lawyer as defence counsel in proceedings.

Fees for legal assistance in criminal proceedings

Lawyer fees concerning violent robbery

Lawyer fees concerning violent robbery depend on the stage, urgency, volume of records, number of episodes and procedural work required. One consultation, examination of several case volumes and defence through a particular stage involve different work. The criminal practice’s starting prices appear in the pricing section; they do not establish an identical budget for every case.

Before work under Article 187 begins, we define what the professional fee includes: documents, attendance at actions or hearings, review of materials such as identification and seizure materials, and reporting arrangements. Additional expert work, translation, travel and necessary expenses are discussed separately. Changes to the scope also require agreement; payment does not guarantee a procedural outcome.

Practical preparation for legal representation

Reconstruct the attack and property-related sequence: when the threat arose, what each participant did, whose item it was and how the event ended. Identify information known only from someone else. Counsel compares the account with records rather than adjusting it to a preferred legal classification.

Keep initial medical documents, attendance dates and treatment records. Where an examination occurred, obtain its findings and the underlying materials where lawfully available. Further legal and expert questions are identified after reviewing what is actually known.
