Legal assistance in criminal proceedings

  • Defence during searches, detention and interviews.
  • Review of permits, provenance and lawful authority to possess an item.
  • Work on ballistic and other expert findings.
  • Assessment of classification and grounds under Article 263(3).

Objects and conduct examined under Article 263

We identify the seized object, characteristics and basis for the category alleged. A common name or appearance does not replace examination. Expert findings, inputs and the actual conduct must be checked: acquisition, storage, carrying, transfer or another form. Different objects and acts can raise different legal issues. The review connects established characteristics with classification of the specific episode rather than relying on a broad description.

Permits and other records, personal status and acquisition circumstances are assessed separately. Origin in a combat area or a reference to defence needs does not provide a universal answer about the legal regime. Applicable law, dates and actual evidence matter. The defence examines knowledge, control and participation, especially where several people used the storage location. Presence in a room does not itself establish every element of liability.

Objects and conduct covered by Article 263

An item’s appearance does not establish its legal characteristics. Under paragraph one, counsel examines whether it is a firearm, ammunition, explosive substance or device, taking statutory exceptions into account. Paragraph two has its own list of conduct concerning bladed or other qualifying non-firearm weapons; it cannot simply be applied to every knife stored at home. We distinguish acquisition, carrying, storage, transfer and distribution; manufacture or modification may require assessment under separate provisions. Permits, other lawful authority, provenance and the person’s knowledge are examined. Martial law does not create a blanket right to retain any found weapon: the applicable special procedure and supporting records require individual review.

Consultation and preparation for a procedural action

During a consultation, the lawyer separates established information from assumptions and identifies the immediate task: responding to a summons, challenging a restriction on property or requesting case materials. Provide complete copies of the summons, notice of suspicion or court order, together with records of actions already taken. The date a document was served can matter as much as its contents, so retain envelopes and delivery notifications.

A witness, injured party and suspect have different procedural rights. Counsel explains the right not to incriminate oneself or close relatives and checks whether the stated status reflects the person’s actual position. Preparing for an interview means reconstructing one’s own chronology and understanding the procedure; it does not mean rehearsing a preferred account. If an interview has already taken place without counsel, we examine its record and potential procedural consequences.

Online consultation with a lawyer

An initial document review and discussion can take place remotely. Before the meeting, identify the next hearing or interview date, any detention and current restrictions. Send complete materials through an agreed channel: an image of one paragraph may omit conditions essential to the assessment. Attendance at an investigative action or court hearing requires a separate arrangement; an online consultation does not automatically replace that attendance.

Working with Prikhodko & Partners

Clients receive explanations of specific procedural tasks: what needs checking, which application addresses the issue and what the investigator or court can decide. Our position rests on case materials rather than an assumption that any procedural defect will automatically end the proceedings. Authority to act, communication arrangements and the scope of instructions are agreed before the relevant work begins.

We check for conflicts of interest at the outset. Representing a suspect and an injured party in the same dispute cannot be combined contrary to professional requirements. Where another representative was previously involved, we establish which applications have been submitted and which orders remain effective, so that further steps do not contradict the existing position. Confidential matters are handled within the protections of lawyer-client confidentiality.

Search, seizure and expert examination

We examine the legal basis, report, recording and inventory. Objects seized are compared with those submitted to the expert, including packaging, identifying features and questions. If the allegation relies on a particular characteristic, the opinion should address it. Procedure and substance are considered together: a formal criticism needs explanation of its relevance to acquisition, reliability or admissibility rather than an assumption that every defect resolves the case.

Someone finding a suspicious object should not carry it to a lawyer’s office or test whether it works. A safe lawful means of notifying the competent authorities is needed. Advice can explain the procedure but does not replace safety measures or specialist knowledge. For existing proceedings, provide the records, seizure information and scheduled actions. Further assistance follows the actual circumstances and procedural status without instructing unsafe handling or independent movement of the objects.

Ballistic findings and attribution of possession

We examine the discovery record, exact location, access by others and packaging. Discovery in shared premises does not automatically establish knowing possession by everyone using them. For expert findings, we check the item’s identity, questions, method, usability and characteristics. A technical label does not replace legal classification or proof of fault. Permit and registration records must be checked for dates, holder and scope. Where messages or transfers are alleged, their complete context and attribution matter. Inconsistencies may justify requests for records, questioning of an expert or further examination. Do not independently dismantle, transport or test a dangerous object to prepare evidence.

Voluntary surrender and a safe response

Article 263(3) provides a specific ground for exemption from criminal liability for the conduct it covers where items are voluntarily surrendered to the authorities. Its application depends on actual voluntariness and proper documentation, not the label given to a statement after seizure. Counsel assesses the conditions and appropriate assistance. Do not bring a dangerous item to an office or send it by post: notifying the competent services requires a safe procedure.

Searches, property restrictions and preventive measures

During a search, counsel examines its legal basis, permitted scope and documentation of seized items. Accurate descriptions, packaging, continuity of recording and inclusion of objections in the official record can all matter. Keeping a copy helps establish exactly what was seized and the stated basis for retaining it. Returning temporarily seized property and lifting a court-imposed property restriction require different applications depending on the current procedural decision.

For a preventive-measure hearing, we prepare submissions on the basis for suspicion and the alleged procedural risks. Evidence of residence, health, employment and family responsibilities should address identified circumstances rather than form a generic bundle. Availability of bail or another measure depends on the offence, procedural stage and any special rules applicable at the time of the hearing.

Legal fees and scope of instructions

Fees depend on the available material, urgency, number of procedural actions and stage of proceedings. A single attendance, a specific complaint and representation through trial involve different commitments. We agree what is included, how further attendance is charged and whether an expert, interpreter or travel expenses are needed. A legal fee pays for agreed professional work rather than a predetermined court outcome.

Fees for assistance in a weapons case

The estimate reflects objects, episodes, opinions, volume and urgency. One investigative attendance, an expert review and full representation involve different tasks. We agree file review, applications, preventive-measure hearings, trial and later stages. The budget should identify actual work rather than only an article number. Additional objects or newly required actions may change the engagement and are discussed with the client.

For an estimate, explain status, seizure or suspicion documents and the next date. Specialists, further examinations, translation and travel are agreed where necessary. Starting criminal practice rates indicate corresponding service formats. Reviewing the file establishes the actions, payment and arrangements for additional attendance. The fee is not payment for guaranteed termination or a predetermined judicial assessment, but for professional assistance with the identified legal tasks.

Court practice concerning voluntary surrender

In its decision of 11 October 2023 in case No. 756/15397/19, the Criminal Court of Cassation distinguished consent to inspect a home from voluntary surrender of weapons. The actual circumstances of delivery matter, rather than only the name of a statement or absence of objections.

Application of the provision requires review of records and chronology. Release from liability cannot be promised simply because an object was handed over after discovery became inevitable. Judicial reasoning helps assess statutory conditions and a specific argument. Subsequent steps must respect current procedure, safety and the stage of the case. Legal assessment does not require the client to manipulate dangerous objects or bypass authorised specialists.

The object’s properties and a safe response

A description in a seizure record does not replace establishing an object’s characteristics and its connection to a person. Relevant materials include seizure records, permits and expert findings. Do not dismantle or transport a potentially dangerous item yourself; notifying competent services requires a safe procedure.

Frequently asked questions

Does Article 263 apply to every knife?

No. The relevant weapon characteristics and the conduct listed in paragraph two must be established. A common description or visual appearance does not replace proper assessment.

Can surrender be treated as voluntary after a search?

Voluntariness depends on the actual circumstances. A statement after discovery and seizure does not guarantee exemption. Timing, ability to dispose of the item and procedural records require assessment.

Can a lawyer join after a notice of suspicion has been served?

Yes. Counsel can review the notice, available evidence and restrictions at that stage. Provide records of earlier actions: changing representatives does not automatically restore an expired procedural deadline.

Must I visit an office for an initial meeting?

The initial consultation can take place remotely. Authority, venue, timing and the procedurally permitted form of attendance are agreed separately for a specific investigative action or hearing.

Does the initial agreement include an appeal against conviction?

The agreement defines its scope. Investigation, trial and appeal may be separate instructions. Once a decision is received, arrange assessment of potential grounds and preparation of an appeal in time to meet the applicable deadline.
