Legal services in treason proceedings

The work depends on the stage and actions already taken. A detained person may need assistance with the next procedural step; a witness may need their status clarified and preparation for questioning. We define the instruction and sequence after receiving the available records.

  • Advice concerning a summons, detention, search or notice of suspicion.
  • Defence counsel’s participation within properly documented authority.
  • Review of the allegation, prosecution material and evidence available at the relevant stage.
  • Preparation of applications, objections, complaints and procedural documents.
  • Defence at preventive-measure hearings, trial and agreed appeal stages.

Attending one interview and conducting an entire case involve different work. We agree counsel’s actions, necessary records and any later stages before starting. Where a relative makes contact, we establish the person’s status, whereabouts and information needed to organise assistance. The boundaries of the work are recorded in the engagement.

Facts examined in defence under Article 111

We identify the precise acts alleged, their timing and how the prosecution explains their purpose. References to contacts, messages or residence in a particular territory do not resolve every element of the offence. The content of the interaction, the person’s role and awareness, the alleged form of treason and supporting evidence must be examined individually.

We also assess distinctions from collaboration offences or unlawful dissemination of particular information. This concerns conduct, purpose, the person liable and other legal elements, rather than simply changing an article number. The complete suspicion notice, available decisions and supporting records are needed. A publication or summary of the case cannot replace those documents or establish all the circumstances relevant to the client.

Advice on an allegation under Article 111

We examine the document and chronology. It matters which actions are alleged, the period concerned and the prosecution’s factual basis. Counsel distinguishes established facts, the client’s account and questions that cannot be assessed without case materials.

Article 111 of Ukraine’s Criminal Code concerns treason by a Ukrainian citizen. Classification depends on the elements established. Communication, presence in a particular territory or an individual message does not replace assessment of the circumstances as a whole.

An initial review does not justify promising withdrawal of an allegation or a particular decision. Where only part of a record is available, we explain the limits. The defence must reflect the allegation, lawful ways to establish facts and risks of inconsistent explanations. New material may change an earlier assessment, so developments should be reported promptly.

Online consultation

A remote discussion can address a summons, review copies and arrange assistance. Identify the next procedural date and whether the person can contact counsel directly. Records should not be sent to unknown intermediaries; agree the communication channel and required set with the professional involved.

Provide complete, legible documents, annexes, dates and identifying details. An online discussion does not replace counsel’s attendance at a procedural action. Where travel or personal attendance is needed, location, timing and practical arrangements are agreed separately. Initial contact should establish the actual assignment rather than imply that every service can be provided by telephone.

Working with Prikhodko & Partners

Work focuses on the records, client status and immediate procedural tasks. We explain documents clearly, identify unconfirmed points and agree the position. General commentary on prominent cases cannot replace an individual assessment.

Confidentiality, representative authority and defined instructions form the basis of cooperation. If another defender is involved, we establish the steps completed and coordination arrangements. This helps avoid conflicting submissions and identifies additional review without unnecessarily repeating previous work.

Company awards and recognition

Messages, electronic devices and evidence sources

Communications are reviewed as a conversation, not only selected extracts. Authorship, source, dates, chronology and connection to the allegation are checked. Where covert measures, device examinations or expert reports are relied on, we examine the relevant records and available verification. The presence of a file does not itself answer questions about its origin, reliability or significance to a particular person.

Preserve procedural documents and tell the lawyer about the next action or hearing. Materials with evidential significance should not be altered, and accounts should not be coordinated with other participants. Lawful assistance involves evaluating evidence, preparing the position and exercising rights. Confidential information is provided through an agreed channel, restricting unnecessary dissemination while allowing the defence to understand the records and immediate procedural tasks.

Searches, questioning and preventive-measure hearings

Before questioning, counsel clarifies the person’s status and the action involved, explaining rights and possible implications of answers. During a search, counsel examines the documents presented, procedure and recording of results within the participation available. Objections and irregularities require appropriate recording rather than only discussion afterwards.

A preventive-measure application requires the particular request, attachments and alleged risks to be examined. A specific measure cannot be promised without assessing the rules and circumstances. Counsel prepares submissions, supporting records and objections for the issue being heard. Personal information relied on must support the relevant arguments.

If devices or documents are seized, we review the record, inventory and procedural basis for further restrictions. Applications concerning restraint, access or return are considered separately on the material available. Keep copies received and inform your lawyer about subsequent decisions.

Evidence and legal classification

Messages, recordings, testimony, documents and electronic data may be examined. Their source, completeness and context matter to a defence. An isolated quotation may not convey a conversation’s meaning, but an alternative account also needs support.

Counsel checks whether conclusions match the material, what remains unresolved and which applications may be appropriate at the current stage. Preserve original files, records and correspondence without alteration. Legal assistance does not involve destroying information, coordinating false testimony or interfering with witnesses. Examination of particular material depends on procedural rules and access to the file.

Reviewing intent and the alleged assistance

Article 111 requires proof of the particular form of treason and intentional conduct harming the protected interests, not merely citizenship and contact. Counsel compares instructions, recipients, timing and actual actions with the allegation. An everyday message, performance of employment duties and knowing assistance to subversive activity cannot be equated without examining context. Where coercion is raised, we assess its nature, reality, effect on the ability to control conduct and supporting material. Threats require evidence but should not be ignored because the allegation is serious. Articles 111-1 and 114-2 require separate comparison where the described conduct raises their elements. Special martial-law rules must be checked for a preventive-measure hearing; promising bail without examining the current restrictions would be unfounded.

Stages of the engagement

Provide a chronology and copies already received. Explain previous questioning, statements, seized property and other representatives’ involvement. You do not need to create a legal account yourself: accurate facts and preserved records come first. If a date is uncertain, say so rather than guessing.

Fees for defence in a treason case

The fee depends on the stage, document volume, procedural actions, travel and court work required. Advice, one action and ongoing defence have different boundaries. Services, fees and foreseeable additional expenses are agreed in advance. Translation, expert assessment and travel are considered separately where necessary. Further work arising from new records also requires agreement.

Situation Material Possible assistance
Summons for questioning Summons and procedural status Advice and agreed attendance
Notice of suspicion received Full wording and available records Assessment of the allegation and defence
An application is being heard Request, attachments and previous decisions Objections and defence attendance

What the fee in a treason case covers

The estimate reflects the records, urgency, episodes and stage. Reviewing a suspicion notice and attending one preventive-measure hearing do not constitute the entire investigation. We agree file access, applications, investigative actions, trial work and further instances separately where appropriate. The engagement should identify the stage and procedural tasks covered, together with arrangements for changes when new material appears.

For an estimate, provide the status, existence of a suspicion notice, location and next date. Travel, translation and specialist work are agreed where required. The criminal practice’s starting rates indicate particular formats rather than the same price for every case. After reviewing the documents, we define the necessary assistance and payment terms without promising a particular procedural outcome or an assessment that only the competent authority can make.

Court practice and the alleged form of treason

In its decision of 24 April 2024 in case No. 743/149/23, the Criminal Court of Cassation considered classification of information supplied to assist the aggressor state. Its relevance lies in examining the content and purpose of conduct, rather than only the fact of communication.

We assess whether that approach applies to the client’s facts, which elements are established and what remains disputed. For a defence, this informs arguments about classification and evidence; for a witness, preparation concerns personal knowledge and rights. A judicial reference should explain a specific legal point. It does not replace the case file or predetermine the result of proceedings with different circumstances and evidence.

Contact alone does not establish intent

Article 111 requires assessment of particular acts, their purpose and intent. Communication alone, without its contents and circumstances, does not provide the full legal picture. Distinguish your own recollection from assumptions and provide complete records so counsel can identify matters requiring procedural examination.

Frequently asked questions

When should I contact counsel?

After a summons, detention, search or notice of suspicion, preferably before statements and signatures. If an action has occurred, provide its records and date.

Can a lawyer assist a witness?

Yes. The assistance depends on status and the particular action. The summons and participation arrangements should be clarified first.

Can a relative make contact?

Yes, to initiate contact and organise assistance. Instructions and participation are formalised according to the procedure and the person’s wishes.

Can we start online?

Yes, if a remote discussion suits the request and available copies. Urgent personal attendance must be arranged separately.

Do you guarantee the case will close?

No. Defence depends on the evidence and procedural options. Counsel agrees the work and position but cannot guarantee an investigator’s or court’s decision.
