Seal forgery lawyer (Article 358 of Ukraine’s Criminal Code)

Legal assistance in seal and stamp forgery proceedings. Establishing relevant facts, examining expert findings and protecting your legal position.

A disputed impression on a contract, seizure of a company seal and an allegation of making a false stamp require different enquiries. A seal forgery lawyer identifies the alleged conduct, reviews the expert findings and examines the individual’s role. Prikhodko & Partners provides defence or injured-party representation under separate instructions. Initial materials may include seizure records, a summons or documents showing the suspected forgery.

Legal assistance in criminal proceedings

  • Defence of a director, employee or other person at procedural actions.
  • Assessment of allegations of making or distributing forged seals and stamps.
  • Review of technical document examination and comparison samples.
  • Representation where another party used the client’s identifying particulars.

Distinguishing a seal, an impression and a document

We identify whether the allegation concerns making the instrument, altering an impression or using a forged record. These circumstances are not interchangeable. Ownership, purpose, access and the client’s precise acts must be established, together with any purpose required by law. An opportunity to use a seal does not itself explain what the person did or which consequences are attributed to their conduct.

A missing seal or unusual impression does not establish the offence on its own. We examine document requirements, legal significance and preparation. Where employees or counterparties shared access, each person’s involvement needs proof. The defence checks whether access is distinguished from established manufacture, supply or another act. The document trail matters alongside the image isolated in a particular copy.

Assessing the alleged conduct under Article 358

A forged seal and an inaccurate document are not the same fact. We examine the object concerned, whether making or distribution is alleged and evidence of the statutory purpose. Finding an item in shared premises does not automatically identify its maker or user. Access, provenance and each person’s particular actions require investigation. An impression on a document may not establish how it was applied or whether the seized seal produced it. Equally, a company’s freedom to operate without a seal is not a universal answer to an Article 358 allegation. Classification depends on the object’s characteristics and proven conduct, not only business recordkeeping rules.

Consultation and preparation for a procedural action

During a consultation, the lawyer separates established information from assumptions and identifies the immediate task: responding to a summons, challenging a restriction on property or requesting case materials. Provide complete copies of the summons, notice of suspicion or court order, together with records of actions already taken. The date a document was served can matter as much as its contents, so retain envelopes and delivery notifications.

A witness, injured party and suspect have different procedural rights. Counsel explains the right not to incriminate oneself or close relatives and checks whether the stated status reflects the person’s actual position. Preparing for an interview means reconstructing one’s own chronology and understanding the procedure; it does not mean rehearsing a preferred account. If an interview has already taken place without counsel, we examine its record and potential procedural consequences.

Online consultation with a lawyer

An initial document review and discussion can take place remotely. Before the meeting, identify the next hearing or interview date, any detention and current restrictions. Send complete materials through an agreed channel: an image of one paragraph may omit conditions essential to the assessment. Attendance at an investigative action or court hearing requires a separate arrangement; an online consultation does not automatically replace that attendance.

Working with Prikhodko & Partners

Clients receive explanations of specific procedural tasks: what needs checking, which application addresses the issue and what the investigator or court can decide. Our position rests on case materials rather than an assumption that any procedural defect will automatically end the proceedings. Authority to act, communication arrangements and the scope of instructions are agreed before the relevant work begins.

We check for conflicts of interest at the outset. Representing a suspect and an injured party in the same dispute cannot be combined contrary to professional requirements. Where another representative was previously involved, we establish which applications have been submitted and which orders remain effective, so that further steps do not contradict the existing position. Confidential matters are handled within the protections of lawyer-client confidentiality.

Company awards and recognition

Technical examination and comparison samples

The review establishes whether the expert studied the instrument, original, copy or digital image, where samples came from and the questions asked. How an impression was produced and who produced it are separate issues. Missing objects affect the limits of possible findings. We check whether the opinion stays within those limits and identify facts left unexamined, which informs the purpose of further procedural applications.

Provide existing records concerning manufacture, storage, transfer, loss and allocation of authority where available. Preserve originals and communications without alterations. Do not experiment with a disputed instrument or create new impressions outside an agreed lawful procedure. The lawyer identifies relevant material and its proper use. The document’s creation date and movement between participants can also matter when reconstructing the alleged episode.

Examining impressions, samples and seized items

Determining how an image was applied and comparing impressions from a particular seal are different expert tasks. We check whether the examiner received the original document, a copy, the seized seal or only a photograph. The quality and quantity of comparison material affect the ability to reach a definite conclusion. Where the question exceeds the available material, counsel prepares reasoned objections and applications. For a seized seal, we review its description, packaging, labelling and transfer to the examiner. A corporate dispute may require examination of access arrangements, handover records and any existing loss reports. Destroying the item or changing business records would undermine examination of the original circumstances.

Seizure of a company seal

We examine the basis for continued retention and the effect on business operations. Return, access to records and challenges to property restrictions depend on procedural status. Where forged particulars were used in a property transaction, the appropriate remedy needs separate assessment: establishing forgery does not always automatically restore the previous position.

Searches, property restrictions and preventive measures

During a search, counsel examines its legal basis, permitted scope and documentation of seized items. Accurate descriptions, packaging, continuity of recording and inclusion of objections in the official record can all matter. Keeping a copy helps establish exactly what was seized and the stated basis for retaining it. Returning temporarily seized property and lifting a court-imposed property restriction require different applications depending on the current procedural decision.

For a preventive-measure hearing, we prepare submissions on the basis for suspicion and the alleged procedural risks. Evidence of residence, health, employment and family responsibilities should address identified circumstances rather than form a generic bundle. Availability of bail or another measure depends on the offence, procedural stage and any special rules applicable at the time of the hearing.

Legal fees and scope of instructions

Fees depend on the available material, urgency, number of procedural actions and stage of proceedings. A single attendance, a specific complaint and representation through trial involve different commitments. We agree what is included, how further attendance is charged and whether an expert, interpreter or travel expenses are needed. A legal fee pays for agreed professional work rather than a predetermined court outcome.

Fees in a seal forgery case

The estimate depends on objects, associated records, episodes and procedural work. One impression differs from several instruments within a large document system. Expert review, attendance, applications and trial involvement are defined before starting. Property consequences are agreed separately if necessary. The client should understand whether these tasks are included in the proposed fee or require another engagement alongside the defence.

For an estimate, explain the status, allegation, available opinion and next date. Further examination, translation, travel and instances are assessed where required. The number of impressions alone does not determine cost: complexity and the client’s objective matter. Reviewing the material allows the assistance, payment and arrangements for new records to be agreed. A starting practice rate does not replace individual assessment of the case.

Connecting seal use with conduct and affected rights

Documents bearing the impression and their effects are examined separately: contracts, payments or registration steps may be involved. An affected business needs to identify how its right can be restored. Criminal proceedings do not always resolve a transaction’s validity or return property by themselves. Where necessary, a separate remedy is coordinated with the criminal position, chronology and client’s actual interests.

The defence examines knowledge, purpose, participation and the individual episode. A company role or a design file does not replace those findings. The full creation and use context must be reviewed. Conflicting technical findings, testimony and transfer records require appropriate verification. The position should address the real allegation instead of relying only on whether impressions look alike when other elements remain material.

What an impression examination establishes

Similar impressions do not always identify a particular seal or its user. Source objects, comparison samples and the report’s limits matter. Where access was shared, storage and handover arrangements require assessment; a job title alone does not establish the person’s acts.

Frequently asked questions

Does a matching impression prove our seal was used?

Not automatically. Source material, examination limits and certainty of the finding must be considered. Comparing images may not identify the particular seal or the person who applied the impression.

Does optional use of seals exclude criminal liability?

It is not a universal ground for ending a case. Counsel examines the object, conduct and statutory purpose. Business rules about seals are considered alongside the other circumstances.

Can a lawyer join after a notice of suspicion has been served?

Yes. Counsel can review the notice, available evidence and restrictions at that stage. Provide records of earlier actions: changing representatives does not automatically restore an expired procedural deadline.

Must I visit an office for an initial meeting?

The initial consultation can take place remotely. Authority, venue, timing and the procedurally permitted form of attendance are agreed separately for a specific investigative action or hearing.

Does the initial agreement include an appeal against conviction?

The agreement defines its scope. Investigation, trial and appeal may be separate instructions. Once a decision is received, arrange assessment of potential grounds and preparation of an appeal in time to meet the applicable deadline.
