Rape case lawyer (Article 152 of Ukraine’s Criminal Code)

Confidential legal assistance in a rape case. Protection of your rights, careful examination of evidence and support at procedural actions.

A rape case lawyer may represent an injured person or defend a suspect or accused person. These are separate instructions subject to a conflict check. Prikhodko & Partners handles evidence, applications and attendance at agreed procedural actions. For the initial enquiry, state your procedural status and the next scheduled action; intimate details need not be disclosed in open correspondence.

Legal assistance in criminal proceedings

  • Complaint preparation, representation of the injured party and an agreed civil claim.
  • Defence following a summons, detention, notice of suspicion or indictment.
  • Applications concerning evidence and appropriate conditions for procedural actions.
  • Assessment of grounds for a private hearing and protective measures.

Consent and the circumstances under Article 152

The assessment concerns freely expressed willingness in the surrounding circumstances. Previous acquaintance, a relationship or being together does not automatically establish agreement to particular acts. The lawyer examines the episode, communications and sources supporting each position. Legal assessment requires facts rather than assumptions about lifestyle or personal characteristics. Each material conclusion must be connected to evidence in the particular proceedings.

For a complainant, assistance includes exercising rights, appropriate communication and representation. For a suspect or accused person, it concerns evidence, classification and procedure. A lawyer does not act for opposing interests in the same dispute. We establish the status and check conflicts before accepting instructions. The tasks follow the client’s needs and procedural stage, rather than one standard approach for every sensitive case.

Assessment of the allegation under Article 152

The central classification issue is whether the acts covered by the provision occurred without voluntary consent. Consent is assessed as a free expression of will in the surrounding circumstances. Acquaintance, marriage, previous relations or absence of visible injury do not by themselves establish consent. Equally, a suspicion must rest on proper examination of a particular event rather than a presumption of guilt.

Counsel establishes timing, participants’ ages, the alleged circumstances and the relevant paragraph of the provision. Acts involving a person under fourteen are governed by a specific rule irrespective of purported consent. Articles 152, 153, 155 and 156 are not interchangeable; each has distinct elements. Accurate classification matters both to the defence and to an appropriate response to an injured person’s complaint.

Consultation and preparation for a procedural action

During a consultation, the lawyer separates established information from assumptions and identifies the immediate task: responding to a summons, challenging a restriction on property or requesting case materials. Provide complete copies of the summons, notice of suspicion or court order, together with records of actions already taken. The date a document was served can matter as much as its contents, so retain envelopes and delivery notifications.

A witness, injured party and suspect have different procedural rights. Counsel explains the right not to incriminate oneself or close relatives and checks whether the stated status reflects the person’s actual position. Preparing for an interview means reconstructing one’s own chronology and understanding the procedure; it does not mean rehearsing a preferred account. If an interview has already taken place without counsel, we examine its record and potential procedural consequences.

Online consultation with a lawyer

An initial document review and discussion can take place remotely. Before the meeting, identify the next hearing or interview date, any detention and current restrictions. Send complete materials through an agreed channel: an image of one paragraph may omit conditions essential to the assessment. Attendance at an investigative action or court hearing requires a separate arrangement; an online consultation does not automatically replace that attendance.

Working with Prikhodko & Partners

Clients receive explanations of specific procedural tasks: what needs checking, which application addresses the issue and what the investigator or court can decide. Our position rests on case materials rather than an assumption that any procedural defect will automatically end the proceedings. Authority to act, communication arrangements and the scope of instructions are agreed before the relevant work begins.

We check for conflicts of interest at the outset. Representing a suspect and an injured party in the same dispute cannot be combined contrary to professional requirements. Where another representative was previously involved, we establish which applications have been submitted and which orders remain effective, so that further steps do not contradict the existing position. Confidential matters are handled within the protections of lawyer-client confidentiality.

Medical records, digital material and procedural safeguards

Necessary urgent healthcare takes priority. Legal work uses available medical records, communications and other relevant information. Transfer is arranged confidentially; private details should not be published or circulated unnecessarily. The required package is identified after the initial assessment. Incomplete records should not prevent timely advice about the next procedural action and the rights available to the client.

We examine the conditions of testimony, inspections and examinations, expert inputs and observance of safeguards. Absence of a particular visible trace does not automatically answer every factual question. Equally, one item does not replace the overall assessment. Specialist questions must fall within their competence. Proof of the allegation and legal classification are considered through the proper procedure, taking participants’ rights and the actual evidence sources into account.

Evidence and avoiding further trauma

The injured person’s representative assists with a complaint, necessary examinations and requests concerning safety and privacy. Urgent medical care or protection from a threat should not be delayed pending a consultation. Legal representation does not replace medical treatment or psychological support.

We consider medical records, expert findings, correspondence, CCTV and accounts together. Completeness, lawful collection and the circumstances in which each account was given matter. Where children are involved, counsel checks the special rules for interviews and participation of appropriate professionals. Defence counsel can test reliability through lawful procedural means; pressure, intimidation and coordination of accounts are impermissible.

Privacy and contact between the parties

Protection of personal information requires the appropriate procedural mechanism. Private hearings, protection of data and safety measures do not follow simply from an informal request to a representative. Counsel prepares the relevant application and explains the limits of the decision sought. Attempts to secure a changed account or assume that compensation automatically ends a case create additional risks.

Searches, property restrictions and preventive measures

During a search, counsel examines its legal basis, permitted scope and documentation of seized items. Accurate descriptions, packaging, continuity of recording and inclusion of objections in the official record can all matter. Keeping a copy helps establish exactly what was seized and the stated basis for retaining it. Returning temporarily seized property and lifting a court-imposed property restriction require different applications depending on the current procedural decision.

For a preventive-measure hearing, we prepare submissions on the basis for suspicion and the alleged procedural risks. Evidence of residence, health, employment and family responsibilities should address identified circumstances rather than form a generic bundle. Availability of bail or another measure depends on the offence, procedural stage and any special rules applicable at the time of the hearing.

Legal fees and scope of instructions

Fees depend on the available material, urgency, number of procedural actions and stage of proceedings. A single attendance, a specific complaint and representation through trial involve different commitments. We agree what is included, how further attendance is charged and whether an expert, interpreter or travel expenses are needed. A legal fee pays for agreed professional work rather than a predetermined court outcome.

What determines legal fees in a rape case?

The fee reflects the stage, records, urgency and actions needed. Consultation, an interview, applications, expert analysis and trial work can be agreed separately. For a complainant we also define status and compensation work; for the defence, tasks specific to its stage. Confidentiality is compatible with a clear fee scope. The terms should state included actions and arrangements for expanding assistance.

For an initial estimate, explain the status, location, records and next date. Sensitive material is provided through an agreed method. Psychologist, interpreter or specialist work, additional travel and further instances are assessed where necessary. The fee follows the scope of assistance rather than a promise of a particular decision or another participant’s response. This allows the client to assess the engagement on practical and transparent terms.

Court practice concerning consent

In its decision of 14 May 2024 in case No. 201/11859/21, the Criminal Court of Cassation considered establishing voluntary consent in context. Legal analysis therefore addresses the particular expression of willingness and surrounding facts, rather than relying only on an absence of obvious physical resistance.

We distinguish the legal criterion from findings about what happened. Timing, communications, accounts and acquisition of evidence are checked. A judicial approach requires comparable facts and applicable law. It is not a ready conclusion about a particular person’s guilt or innocence without examination of the file. The reference explains a legal issue while preserving the need for individual assessment and procedural guarantees.

Frequently asked questions

Does absence of physical injury rule out an offence?

No. Voluntary consent and all circumstances must be examined. A medical finding is important but cannot replace assessment of the remaining elements or be considered in isolation.

Can a lawyer guarantee a private hearing?

No. Counsel assesses the grounds, prepares a reasoned application and makes submissions. The hearing arrangements depend on the law and the court’s decision.

Can a lawyer join after a notice of suspicion has been served?

Yes. Counsel can review the notice, available evidence and restrictions at that stage. Provide records of earlier actions: changing representatives does not automatically restore an expired procedural deadline.

Must I visit an office for an initial meeting?

The initial consultation can take place remotely. Authority, venue, timing and the procedurally permitted form of attendance are agreed separately for a specific investigative action or hearing.

Does the initial agreement include an appeal against conviction?

The agreement defines its scope. Investigation, trial and appeal may be separate instructions. Once a decision is received, arrange assessment of potential grounds and preparation of an appeal in time to meet the applicable deadline.
