Lawyer under Article 366 of Ukraine’s Criminal Code — Official forgery

Review of official documents, authority and evidence of knowledge, with defence under Article 366 of Ukraine’s Criminal Code.

An inconsistency in a certificate, report or other record may lead to an official-forgery investigation. An Article 366 lawyer identifies the document, alleged conduct, official status and evidence of knowing falsity. Assistance may be useful from the first summons or document seizure.

Legal assessment under Article 366 of Ukraine’s Criminal Code

Article 366 covers the specified acts by an official involving official records, including knowingly false preparation or issuance, false entries and other official forgery. The document’s characteristics, authority, act and knowledge must be established. A technical mistake should not be equated with intentional distortion without examination.

Official forgery differs from general document forgery under Article 358. The person, document, method of creation or use and other circumstances matter. The heading certificate or report is insufficient on its own; counsel examines content, legal significance, particulars and the creation procedure.

Evidence and circumstances the lawyer examines

We examine the original, available versions, data sources and approval chain. Electronic records may require change logs, signature information, access records and timing. A name in the document does not always establish who entered particular data or on what basis. These matters are compared with explanations and technical evidence.

The allegation of knowledge requires checking what the person received before signing, the opportunity to verify and changes in source information. Handwriting, technical or other examinations may be relevant. An expert’s conclusion must be considered within the questions and materials supplied and cannot replace the legal determination of guilt.

  • The document and available versions.
  • The allegation and seizure records.
  • Sources of primary data.
  • Signing rules and official duties.
  • Electronic logs and approval correspondence.
  • Expert reports and court orders.

Legal assistance during investigation and in court

Counsel establishes procedural status, reviews seizure records and helps preserve available copies and registration information. The position addresses the specific document and conduct. Agreed motions may seek originals, creation data, witness testimony or an appropriate examination.

Court defence can address provenance, the signatory’s authority, technical information and the allegation of knowledge. Where serious consequences are alleged, both the consequences and causation require review. Challenges depend on the actual records; a general inaccuracy does not automatically determine the entire case.

Stages of working with a lawyer

Lawyer consultation concerning official forgery

A consultation concerning official forgery starts with your procedural status, the records received and the next scheduled date. We distinguish issues that can already be assessed from those requiring additional case materials.

For a meaningful review under Article 366, provide available records such as the document and available versions and the allegation and seizure records in advance where possible. Do not select only favourable extracts: inconsistencies matter when assessing risks. We explain the available procedural steps, documents needed and limits of the proposed assignment. A consultation, a single submission and continuing case representation are different engagements.

An online consultation concerning official forgery can provide an initial review remotely. Communication and file-sharing arrangements are agreed with counsel. Personal attendance at an investigative action or hearing is arranged separately according to the procedure and location. Sending an enquiry does not automatically appoint a lawyer as defence counsel in proceedings.

Fees for legal assistance in criminal proceedings

Lawyer fees concerning official forgery

Lawyer fees concerning official forgery depend on the stage, urgency, volume of records, number of episodes and procedural work required. One consultation, examination of several case volumes and defence through a particular stage involve different work. The criminal practice’s starting prices appear in the pricing section; they do not establish an identical budget for every case.

Before work under Article 366 begins, we define what the professional fee includes: documents, attendance at actions or hearings, review of materials such as signing rules and official duties, and reporting arrangements. Additional expert work, translation, travel and necessary expenses are discussed separately. Changes to the scope also require agreement; payment does not guarantee a procedural outcome.

Practical preparation for legal representation

Prepare the sequence of who supplied data, edited, checked and signed the document and when the discrepancy was found. Approval emails, internal rules, registers and evidence of corrections may help. Preserve them as they are rather than producing retrospective confirmations.

Where several versions exist, do not simply select one as correct and discard the rest. Counsel compares differences and identifies technical questions. Text authorship, signing and awareness of content are distinct issues requiring examination, not interchangeable assumptions.

Frequently asked questions

Is every mistake in an official record forgery?

No. The statutory elements, act and knowledge must be examined. A technical inaccuracy does not replace proof of intentional conduct.

How does Article 366 differ from Article 358?

The distinction depends on the person, document, conduct and other elements. Official status and the nature of the official record are particularly important for Article 366.

Why preserve earlier versions?

They may establish data sources, timing and individual roles. Provenance and technical information matter alongside the final printout.

Can the consultation take place online?

Yes. The initial review under Article 366 of Ukraine’s Criminal Code can be arranged remotely. The scope, documents and any subsequent personal attendance are agreed separately.

How is the fee calculated?

By the stage and scope of the engagement concerning official forgery, including the records, urgency, documents and attendance needed. Starting prices should be considered together with the actual work agreed.
