Extortion lawyer (Article 189 of Ukraine’s Criminal Code)

Protecting your rights in an extortion case. Assessment of property demands, threats and evidence to develop a position grounded in the circumstances.

Are demands for money accompanied by threats, is private information being used for pressure, or have debt collection efforts led to an extortion allegation? An extortion lawyer examines the demand, alleged threat and legal basis of the dispute. Prikhodko & Partners represents injured parties or provides defence under separate instructions, including complaints, procedural attendance, review of recordings and court representation.

Legal assistance in criminal proceedings

  • Complaints about property demands and threats; representation of the injured party.
  • Defence following detention, at interviews and preventive-measure hearings.
  • Review of messages, recordings, payments and special investigative measures.
  • Distinguishing extortion from a debt dispute and related offences.

The demand, threat and property interest

We examine the demand, recipient, threatened consequence and connection to property, a right or a property-related act. A fragment of conversation may not show the whole situation. The conflict’s origin, later contacts and participants’ understanding are relevant. Classification concerns conduct rather than everyday labels such as blackmail or debt recovery. Each person’s alleged act should be identified and connected to supporting sources.

Where a genuine obligation is raised, we check debt records and the circumstances of the demand. A debt dispute does not authorise any form of pressure, but matters when distinguishing offences. The legal basis, threats and actions must be compared. The lawyer assesses all elements rather than automatically accepting one account. A receipt and a disagreement do not replace analysis of how the demand was made and what it sought.

Extortion and disputes over a debt

Article 189 requires more than an insistent request for payment. We examine the property demand and its connection with a statutory threat, such as violence, restriction of rights, property damage or disclosure of unwanted information. The absence of an actual payment does not itself exclude liability. Equally, an ordinary creditor’s demand is not extortion merely because the debtor disputes the amount. Alleged coercion to perform an existing obligation requires consideration of Article 355 and other potentially applicable provisions. A debt acknowledgment does not authorise threats. Martial-law circumstances, alleged group involvement and claimed loss require separate legal and evidential assessment under the relevant paragraph.

Consultation and preparation for a procedural action

During a consultation, the lawyer separates established information from assumptions and identifies the immediate task: responding to a summons, challenging a restriction on property or requesting case materials. Provide complete copies of the summons, notice of suspicion or court order, together with records of actions already taken. The date a document was served can matter as much as its contents, so retain envelopes and delivery notifications.

A witness, injured party and suspect have different procedural rights. Counsel explains the right not to incriminate oneself or close relatives and checks whether the stated status reflects the person’s actual position. Preparing for an interview means reconstructing one’s own chronology and understanding the procedure; it does not mean rehearsing a preferred account. If an interview has already taken place without counsel, we examine its record and potential procedural consequences.

Online consultation with a lawyer

An initial document review and discussion can take place remotely. Before the meeting, identify the next hearing or interview date, any detention and current restrictions. Send complete materials through an agreed channel: an image of one paragraph may omit conditions essential to the assessment. Attendance at an investigative action or court hearing requires a separate arrangement; an online consultation does not automatically replace that attendance.

Working with Prikhodko & Partners

Clients receive explanations of specific procedural tasks: what needs checking, which application addresses the issue and what the investigator or court can decide. Our position rests on case materials rather than an assumption that any procedural defect will automatically end the proceedings. Authority to act, communication arrangements and the scope of instructions are agreed before the relevant work begins.

We check for conflicts of interest at the outset. Representing a suspect and an injured party in the same dispute cannot be combined contrary to professional requirements. Where another representative was previously involved, we establish which applications have been submitted and which orders remain effective, so that further steps do not contradict the existing position. Confidential matters are handled within the protections of lawyer-client confidentiality.

Company awards and recognition

Messages, recordings and transfers

Preserve messages with sender information, dates and context. Audio and video require assessment of source and acquisition, not merely a selected extract. The lawyer considers their use through the proper procedure. Immediate danger should not be left unreported while a person independently gathers a perfect package. Avoid risky meetings or private detention operations: lawful recording and action require the appropriate authority and safety measures.

The case file is examined for contacts, transfers and each participant’s role. Where controlled operations or covert measures are involved, decisions, limits and implementation matter. The defence assesses provocation and admissibility issues; the injured party receives advice about status, damage and available rights. Individual recordings need to be connected with chronology and other evidence rather than treated as a complete account of the allegation.

Messages, recordings and money transfers

Counsel examines the whole exchange: who made the demand, its recipient, the threatened act and the stated conditions. An isolated voice message may omit essential context. Electronic evidence requires examination of provenance, integrity, attribution and lawful collection. Preserve original messages and files without editing. Where a controlled transfer or other special investigative measure occurred, defence counsel checks authorisation, scope, documentation and possible inducement. Law-enforcement involvement does not automatically make every item admissible, but an unsupported objection is insufficient. An injured person should not independently arrange a dangerous meeting or promise payment on advice from unidentified intermediaries.

Responding to pressure and seeking protective measures

Where life or health is under an immediate threat, contacting the appropriate emergency service takes priority. Counsel can then help set out the facts in a complaint, document its submission and assess grounds for procedural safety measures. Filing a complaint does not guarantee immediate removal of danger; steps depend on the particular risk. Counter-threats or publishing private material to pressure another party can create further problems.

Searches, property restrictions and preventive measures

During a search, counsel examines its legal basis, permitted scope and documentation of seized items. Accurate descriptions, packaging, continuity of recording and inclusion of objections in the official record can all matter. Keeping a copy helps establish exactly what was seized and the stated basis for retaining it. Returning temporarily seized property and lifting a court-imposed property restriction require different applications depending on the current procedural decision.

For a preventive-measure hearing, we prepare submissions on the basis for suspicion and the alleged procedural risks. Evidence of residence, health, employment and family responsibilities should address identified circumstances rather than form a generic bundle. Availability of bail or another measure depends on the offence, procedural stage and any special rules applicable at the time of the hearing.

Legal fees and scope of instructions

Fees depend on the available material, urgency, number of procedural actions and stage of proceedings. A single attendance, a specific complaint and representation through trial involve different commitments. We agree what is included, how further attendance is charged and whether an expert, interpreter or travel expenses are needed. A legal fee pays for agreed professional work rather than a predetermined court outcome.

Calculating fees in an extortion case

The estimate reflects urgency, contacts, episodes, digital records and stage. Advice on messages, attendance at an investigative action and complete representation involve different tasks. Specialist investigation records, applications, trial and damage claims need an agreed scope. Starting rates do not mean that an extensive case is included in a one-off service. The stage through which assistance is provided should be identified.

For an estimate, provide the status, documents, record volume and next date. Travel, translation, specialists and further instances are agreed where needed. Payment covers legal work rather than a promise to recover an amount or obtain a particular decision. The client should understand the engagement, reporting and process for agreeing additional tasks if new evidence changes the necessary scope of assistance.

Legal assessment of arrangements with the other party

After threats or commencement of proceedings, a person may be asked to sign a receipt, alter explanations or restate demands. The document’s content and consequences need review before agreement. A lawyer distinguishes lawful property settlement from influencing testimony or obstructing an investigation. A statement ending complaints does not automatically determine the criminal case. The real subject and applicable procedure must be assessed.

We organise the chronology and immediate objectives: a report, interview, preventive measure or property claim. New facts are checked against preserved records. Public accusations and private pressure do not replace an evidential position. Assistance focuses on lawful actions and clear communication according to the client’s actual status, the case stage and the limits of the instructions accepted by the lawyer.

A debt does not authorise threats

The demand, alleged threat and legal basis of the relationship matter. A debt acknowledgment does not justify unlawful pressure, while disputing a sum does not make every demand criminal. Preserve the complete correspondence and obligation records, rather than an isolated phrase from a conversation.

Frequently asked questions

Can threatening disclosure of private information constitute extortion?

It may form part of the offence when combined with a relevant property demand and the other statutory elements. Content, recipient and circumstances require examination; simply calling a message blackmail is insufficient.

Does no payment mean there can be no prosecution?

No. The demand, threat and timing of the alleged conduct matter. Counsel examines the evidence and the stage reached by the alleged conduct.

Can a lawyer join after a notice of suspicion has been served?

Yes. Counsel can review the notice, available evidence and restrictions at that stage. Provide records of earlier actions: changing representatives does not automatically restore an expired procedural deadline.

Must I visit an office for an initial meeting?

The initial consultation can take place remotely. Authority, venue, timing and the procedurally permitted form of attendance are agreed separately for a specific investigative action or hearing.

Does the initial agreement include an appeal against conviction?

The agreement defines its scope. Investigation, trial and appeal may be separate instructions. Once a decision is received, arrange assessment of potential grounds and preparation of an appeal in time to meet the applicable deadline.
