Document forgery lawyer (Article 358 of Ukraine’s Criminal Code)

An evidence-based legal position in a document forgery case. Review of provenance, expert findings and legal consequences to protect your interests.

Has a document been seized, have you been summoned about its origin, or has someone else’s forgery affected your rights? A document forgery lawyer examines the alleged offence, provenance and whether use was knowing. Prikhodko & Partners can provide defence or representation of the injured party. The first priorities are procedural status, the location of the original and the next scheduled action.

Legal assistance in criminal proceedings

  • Defence during interviews, searches and document seizure.
  • Assessment of official-document status and the relevant paragraph of Article 358.
  • Applications on signatures, particulars, forms and electronic evidence.
  • Representation where a forged document has affected a person’s rights.

Identifying the document alleged to be forged

We establish the particular record, purpose, origin and legal significance. Not every inaccurate written statement automatically meets the relevant offence’s document requirement. The author’s powers, required particulars and facts or rights certified must be checked. We identify the alleged alteration to a signature, detail, content or other operation before assessing the person’s role. An allegation should explain the document concerned rather than rely on a general description.

Making, supplying and using a document must be distinguished under the facts and provision alleged. Receiving a record from someone else does not itself establish awareness of its origin. The defence examines knowledge, acquisition and presentation. A person affected by its use needs assessment of the method and legal consequences. Each episode is connected to evidence rather than simply labelled inaccurate paperwork.

Creation, distribution and knowing use

Article 358 covers different forms of conduct. Making or distributing a forgery must be distinguished from knowingly using a forged document. Possession does not automatically establish authorship or knowledge. For alleged use, counsel examines when, to whom and for what purpose the document was presented, and what evidence supports alleged knowledge of the forgery.

Not every inaccurate written statement is an official document for this provision. We examine the issuer, authority, required particulars and legal significance. Where an official’s conduct is involved, the elements of official forgery under Article 366 require separate consideration. A clerical mistake, a civil dispute over a transaction and criminal forgery call for different legal assessments.

Consultation and preparation for a procedural action

During a consultation, the lawyer separates established information from assumptions and identifies the immediate task: responding to a summons, challenging a restriction on property or requesting case materials. Provide complete copies of the summons, notice of suspicion or court order, together with records of actions already taken. The date a document was served can matter as much as its contents, so retain envelopes and delivery notifications.

A witness, injured party and suspect have different procedural rights. Counsel explains the right not to incriminate oneself or close relatives and checks whether the stated status reflects the person’s actual position. Preparing for an interview means reconstructing one’s own chronology and understanding the procedure; it does not mean rehearsing a preferred account. If an interview has already taken place without counsel, we examine its record and potential procedural consequences.

Online consultation with a lawyer

An initial document review and discussion can take place remotely. Before the meeting, identify the next hearing or interview date, any detention and current restrictions. Send complete materials through an agreed channel: an image of one paragraph may omit conditions essential to the assessment. Attendance at an investigative action or court hearing requires a separate arrangement; an online consultation does not automatically replace that attendance.

Working with Prikhodko & Partners

Clients receive explanations of specific procedural tasks: what needs checking, which application addresses the issue and what the investigator or court can decide. Our position rests on case materials rather than an assumption that any procedural defect will automatically end the proceedings. Authority to act, communication arrangements and the scope of instructions are agreed before the relevant work begins.

We check for conflicts of interest at the outset. Representing a suspect and an injured party in the same dispute cannot be combined contrary to professional requirements. Where another representative was previously involved, we establish which applications have been submitted and which orders remain effective, so that further steps do not contradict the existing position. Confidential matters are handled within the protections of lawyer-client confidentiality.

Company awards and recognition

Originals, copies and expert examination

We identify whether the object seized or studied was an original, copy, scan or electronic file. This affects available findings and assessment of the opinion. Questions, objects and comparison materials are checked against the alleged operation. A finding of forgery does not automatically establish authorship, knowledge or participation. The review distinguishes matters actually examined from conclusions that remain outside the evidence.

For consultation, provide the suspicion notice or other procedural document, an available copy and the history of acquisition. Do not annotate, correct or destroy the original or related records. The lawyer identifies suitable preservation and examination steps. If use produced consequences outside the criminal case, a separate remedy may be necessary. An investigation does not always reverse a registration or contractual effect without further appropriate action.

Originals, signatures and electronic documents

Handwriting examination may address who made a signature, while technical examination may address alterations or production of a form. These are different questions. We check whether the original was examined, what comparison samples were supplied and whether the conclusions stay within the expert’s competence. Any limitations of examining a copy must be reflected in the evidential position.

For electronic documents, we assess file provenance, electronic signatures, available verification information and transmission history. A signature image in a scan is not equivalent to a qualified electronic signature. Where needed, counsel seeks originals or data from the appropriate holder. Editing a disputed file after an enquiry begins may destroy information about its original state.

Where someone else used a forgery against you

We establish the consequences: a changed register entry, transferred property, an obligation or another decision. Criminal proceedings do not always automatically reverse that consequence. Counsel explains which matters can be addressed within the criminal case and which require a separate remedy. Preserve available originals and submission notices without altering their contents.

Searches, property restrictions and preventive measures

During a search, counsel examines its legal basis, permitted scope and documentation of seized items. Accurate descriptions, packaging, continuity of recording and inclusion of objections in the official record can all matter. Keeping a copy helps establish exactly what was seized and the stated basis for retaining it. Returning temporarily seized property and lifting a court-imposed property restriction require different applications depending on the current procedural decision.

For a preventive-measure hearing, we prepare submissions on the basis for suspicion and the alleged procedural risks. Evidence of residence, health, employment and family responsibilities should address identified circumstances rather than form a generic bundle. Availability of bail or another measure depends on the offence, procedural stage and any special rules applicable at the time of the hearing.

Legal fees and scope of instructions

Fees depend on the available material, urgency, number of procedural actions and stage of proceedings. A single attendance, a specific complaint and representation through trial involve different commitments. We agree what is included, how further attendance is charged and whether an expert, interpreter or travel expenses are needed. A legal fee pays for agreed professional work rather than a predetermined court outcome.

Fees in a document forgery case

The estimate reflects documents, episodes, examinations, file size and stage. Advice on one record differs from a defence involving numerous institutions, devices and opinions. We agree expert review, applications, investigative actions, trial and any property-related work. The terms should identify tasks covered, materials to be examined and how additional work is addressed if the proceedings expand or new evidence becomes available.

For an estimate, provide the status, provision alleged, record volume and next date. Specialists, further examinations, translation and travel are assessed where needed. A fee cannot sensibly be determined only by the name of a certificate. Initial review defines the necessary assistance, payment and additions to instructions. The engagement concerns legal work rather than a promise that a document will be declared genuine or the proceedings terminated.

Court practice on an official document’s characteristics

In its decision of 5 September 2022 in case No. 310/3772/20, the Joint Chamber of the Criminal Court of Cassation addressed use of a forged record lacking the characteristics of an official document under Article 358(4). The document’s legal status therefore requires independent examination.

The analysis explains its connection to the allegation, not only an incorrect detail. Judicial reasoning must be compared with the record type, author’s competence and circumstances of use. It does not mean that every privately created record lacks legal significance. Specific characteristics must be examined and the conclusion justified in the client’s case. Court practice identifies the legal issue without replacing factual evidence and other conditions of liability.

Why the original document can matter

Examining a copy may not establish how a signature or alteration was made. Authorship, technical features and knowledge of forgery are separate issues. Establish where the original is held and avoid making changes to disputed files yourself.

Frequently asked questions

Does possession alone establish an offence?

Possession alone does not automatically establish making a forgery or knowingly using it. The alleged form of conduct, how it was obtained and evidence of knowledge must be assessed.

Can a copy be examined?

That depends on the question and suitability of the material. A copy may not show how a signature or alteration was made. Counsel assesses the report’s limits and whether the original should be requested.

Can a lawyer join after a notice of suspicion has been served?

Yes. Counsel can review the notice, available evidence and restrictions at that stage. Provide records of earlier actions: changing representatives does not automatically restore an expired procedural deadline.

Must I visit an office for an initial meeting?

The initial consultation can take place remotely. Authority, venue, timing and the procedurally permitted form of attendance are agreed separately for a specific investigative action or hearing.

Does the initial agreement include an appeal against conviction?

The agreement defines its scope. Investigation, trial and appeal may be separate instructions. Once a decision is received, arrange assessment of potential grounds and preparation of an appeal in time to meet the applicable deadline.
