Lawyer under Article 111-1 of Ukraine’s Criminal Code — Collaboration activities

Assessment of alleged collaboration activities and protection of your interests in proceedings under Article 111-1 of Ukraine’s Criminal Code.

Work in temporarily occupied territory, a publication, a speech or contact with occupation structures may become the subject of proceedings under Article 111-1. Counsel establishes the specific acts alleged, the subsection relied on and the supporting materials. Assistance may also be needed after a witness summons, search or notice of suspicion.

Legal assessment under Article 111-1 of Ukraine’s Criminal Code

Article 111-1 addresses different forms of collaboration. Public statements, holding a position, educational, economic and other activities have different elements. The lawyer examines the relevant provision, including the person covered, voluntariness where relevant, actual functions, timing, territory and conduct. A general statement that someone cooperated is not a complete individual legal assessment.

Living under occupation or any business activity should not automatically be treated as proof of the offence. Equally, a reference to everyday necessity does not itself answer specific allegations. Collaboration must be distinguished from treason and aiding an aggressor state: similar descriptions do not make their legal elements identical.

Evidence and circumstances the lawyer examines

Statements require the complete recording, original publication, conversational context and information about who could access the message. A screenshot or witness summary may omit the author, date or full content. Defence counsel compares digital materials with the records of their acquisition and expert examination, separating established facts from assumptions when formulating questions.

For employment or office-related allegations, we review appointment records, job documents, actual duties and the conditions in which the person acted. Evidence of pressure, movement restrictions, threats or attempts to stop the activity may matter. Materials must be obtained and submitted lawfully, preserving their source. Counsel identifies missing information and its connection to the particular episode.

  • The notice of suspicion and summons.
  • Original publications and complete recordings.
  • Appointment records and actual duties.
  • Documents concerning pressure or threats.
  • The employment or speech timeline.
  • Procedural records and expert reports.

Legal assistance during investigation and in court

The initial review covers the notice of suspicion, procedural records, available evidence, status and upcoming deadlines. We then agree a position for the episodes and prepare appropriate motions for documents, recordings or witness evidence. Attendance at a preventive-measure hearing, challenging a decision or defence in court may form a separate agreed assignment.

Where a person is abroad or outside government-controlled territory, we establish what documents are known and which procedural steps have occurred. Remote advice does not remove questions of proper notification, personal attendance or restrictions. Counsel explains the arrangement available in the particular case rather than promising that every matter can be closed without the client’s participation.

Stages of working with a lawyer

Lawyer consultation concerning collaboration activities

A consultation concerning collaboration activities starts with your procedural status, the records received and the next scheduled date. We distinguish issues that can already be assessed from those requiring additional case materials.

For a meaningful review under Article 111-1, provide available records such as the notice of suspicion and summons and original publications and complete recordings in advance where possible. Do not select only favourable extracts: inconsistencies matter when assessing risks. We explain the available procedural steps, documents needed and limits of the proposed assignment. A consultation, a single submission and continuing case representation are different engagements.

An online consultation concerning collaboration activities can provide an initial review remotely. Communication and file-sharing arrangements are agreed with counsel. Personal attendance at an investigative action or hearing is arranged separately according to the procedure and location. Sending an enquiry does not automatically appoint a lawyer as defence counsel in proceedings.

Working with Prikhodko & Partners

Before work concerning collaboration activities begins, we identify the responsible lawyer, engagement scope and communication arrangements. The client understands which documents are being prepared, the next action and when separate approval is required. Facts obtained during legal assistance are discussed confidentially, with an agreed method for sharing sensitive materials.

Fees for legal assistance in criminal proceedings

Lawyer fees concerning collaboration activities

Lawyer fees concerning collaboration activities depend on the stage, urgency, volume of records, number of episodes and procedural work required. One consultation, examination of several case volumes and defence through a particular stage involve different work. The criminal practice’s starting prices appear in the pricing section; they do not establish an identical budget for every case.

Before work under Article 111-1 begins, we define what the professional fee includes: documents, attendance at actions or hearings, review of materials such as documents concerning pressure or threats, and reporting arrangements. Additional expert work, translation, travel and necessary expenses are discussed separately. Changes to the scope also require agreement; payment does not guarantee a procedural outcome.

Practical preparation for legal representation

When voluntariness is disputed, the sequence matters: when pressure arose, who made demands, what options existed and what the person actually did. A timeline should not be adjusted to a preferred account. Counsel helps distinguish direct observations from assumptions and compare explanations with documents and recordings.

Prepare the dates, positions and acts mentioned in the summons or allegation, and preserve documents in their original form. An incomplete archive from occupied territory does not mean no defence is possible. The first task is to identify accessible corroboration and the limits of conclusions that can responsibly be drawn.

Frequently asked questions

Is any work under occupation a collaboration offence?

The functions, actions and elements of the relevant subsection must be examined. A general job description alone is insufficient.

Can a lawyer review a publication or recording?

Yes. Authorship, context, date, accessibility and acquisition are examined, with expert questions considered where appropriate.

How is coercion considered?

Under the applicable rules and supported circumstances, including the threat, timing and conduct. A single explanation does not establish a guaranteed outcome.

Can the consultation take place online?

Yes. The initial review under Article 111-1 of Ukraine’s Criminal Code can be arranged remotely. The scope, documents and any subsequent personal attendance are agreed separately.

How is the fee calculated?

By the stage and scope of the engagement concerning collaboration activities, including the records, urgency, documents and attendance needed. Starting prices should be considered together with the actual work agreed.
