Bodily injury lawyer (Articles 121, 122, 125, 128 of Ukraine’s Criminal Code)

Protecting your interests in a bodily injury case. Legal assessment of medical evidence, classification and claims for compensation.

An assessment of injury severity affects classification but does not settle every issue of guilt or compensation. A bodily injury lawyer examines medical evidence, causation and the required form of fault. Prikhodko & Partners provides defence or representation of an injured party under separate instructions. Assistance may begin after an injury, an expert finding, a summons or a notice of suspicion.

Legal assistance in criminal proceedings

  • Representation of the injured party and assistance with documentation of consequences.
  • Defence of a suspect and review of causation and the alleged form of fault.
  • Work on expert questions, medical records and procedural applications.
  • Preparation of an evidence-based compensation claim.

Injury severity and legal classification

A diagnosis, treatment duration and criminal classification are related but different matters. Consequences, fault, mechanism and other elements determine the legal assessment. We examine the expert questions and completeness of the inputs. A finding about an injury does not replace proof of who caused it and in what circumstances. The analysis connects medical information with the actual episode and conduct, rather than only a diagnostic label.

The injured person needs proper recording of consequences and available medical records. The defence must assess the alleged mechanism, causation and fault. With several participants, each role is established individually. A shared conflict does not justify attributing every consequence to everyone without further evidence. The lawyer compares accounts with objective information and identifies questions requiring examination through an appropriate procedural action.

Grievous, moderate and minor bodily injuries

Classification is not determined solely by days of treatment or wording in an emergency department note. Severity is assessed under the applicable medical criteria. Articles 121, 122 and 125 concern intentional injuries of different severity; Article 128 concerns negligent grievous or moderate injury. Where no bodily injury occurred, Article 126 may require assessment instead of automatically applying Article 125.

We examine whether the consequences arose from the alleged event, when symptoms appeared and whether the expert considered pre-existing conditions. Intent, negligence, self-defence and each participant’s actions require separate review. For a road traffic incident or another specific offence, the applicable provision depends on its particular elements, not merely the medical outcome.

Consultation and preparation for a procedural action

During a consultation, the lawyer separates established information from assumptions and identifies the immediate task: responding to a summons, challenging a restriction on property or requesting case materials. Provide complete copies of the summons, notice of suspicion or court order, together with records of actions already taken. The date a document was served can matter as much as its contents, so retain envelopes and delivery notifications.

A witness, injured party and suspect have different procedural rights. Counsel explains the right not to incriminate oneself or close relatives and checks whether the stated status reflects the person’s actual position. Preparing for an interview means reconstructing one’s own chronology and understanding the procedure; it does not mean rehearsing a preferred account. If an interview has already taken place without counsel, we examine its record and potential procedural consequences.

Online consultation with a lawyer

An initial document review and discussion can take place remotely. Before the meeting, identify the next hearing or interview date, any detention and current restrictions. Send complete materials through an agreed channel: an image of one paragraph may omit conditions essential to the assessment. Attendance at an investigative action or court hearing requires a separate arrangement; an online consultation does not automatically replace that attendance.

Working with Prikhodko & Partners

Clients receive explanations of specific procedural tasks: what needs checking, which application addresses the issue and what the investigator or court can decide. Our position rests on case materials rather than an assumption that any procedural defect will automatically end the proceedings. Authority to act, communication arrangements and the scope of instructions are agreed before the relevant work begins.

We check for conflicts of interest at the outset. Representing a suspect and an injured party in the same dispute cannot be combined contrary to professional requirements. Where another representative was previously involved, we establish which applications have been submitted and which orders remain effective, so that further steps do not contradict the existing position. Confidential matters are handled within the protections of lawyer-client confidentiality.

Medical documentation and expert questions

We organise attendance records, examinations, discharge information, prescriptions and subsequent treatment documents. A delay in recording injuries is considered in light of its actual reasons. We identify sufficient information and missing records without postponing necessary medical care for legal preparation. Tell the lawyer what is unavailable as well as what you have, so its significance and lawful means of obtaining it can be assessed.

An incomplete or inconsistent opinion may call for clarification, questioning the expert or another examination through the applicable procedure. Disagreement alone does not automatically justify a repeat assessment. The unresolved fact and its importance must be explained. This creates focused evidence work instead of a formal list of applications without a purpose, factual basis or identified legal relevance to the client’s case.

Reviewing medical records and expert findings

Focused review requires initial medical attendance records, examinations, discharge notes, images and the available expert report. Counsel compares these with timing and the alleged mechanism of injury. Incomplete source material or inconsistencies may justify questions and an assessment of grounds for supplementary or repeat examination.

A medical note, photograph and forensic report serve different purposes. Photographs can document changes but do not replace professional assessment of severity. Defence work addresses attribution and causation; injured-party representation includes obtaining and preserving full records of the consequences. A lawyer does not diagnose an injury or replace a doctor.

Treatment costs and non-pecuniary harm

For a claim, we organise receipts, prescriptions, payment records, evidence of lost earnings and other relevant material. An expense is not automatically attributable to an offence: its necessity and causal connection need support. Non-pecuniary harm also requires an explanation of the actual consequences. Voluntary payment is assessed separately from whether a lawful ground exists to end the criminal proceedings.

Searches, property restrictions and preventive measures

During a search, counsel examines its legal basis, permitted scope and documentation of seized items. Accurate descriptions, packaging, continuity of recording and inclusion of objections in the official record can all matter. Keeping a copy helps establish exactly what was seized and the stated basis for retaining it. Returning temporarily seized property and lifting a court-imposed property restriction require different applications depending on the current procedural decision.

For a preventive-measure hearing, we prepare submissions on the basis for suspicion and the alleged procedural risks. Evidence of residence, health, employment and family responsibilities should address identified circumstances rather than form a generic bundle. Availability of bail or another measure depends on the offence, procedural stage and any special rules applicable at the time of the hearing.

Legal fees and scope of instructions

Fees depend on the available material, urgency, number of procedural actions and stage of proceedings. A single attendance, a specific complaint and representation through trial involve different commitments. We agree what is included, how further attendance is charged and whether an expert, interpreter or travel expenses are needed. A legal fee pays for agreed professional work rather than a predetermined court outcome.

Fees for assistance in a bodily injury case

The estimate depends on stage, episodes, expert issues and representation. Reviewing an opinion, attending an investigative action and conducting a trial involve different work. Damage claims require an agreed scope. At the outset we define access, actions and the stage covered. The client should understand the difference between advice on supplied records and continuing representation throughout the proceedings.

For an estimate, explain the status, medical and procedural records and next date. Specialists, interpretation, travel and further instances are discussed where required. The amount claimed as damage does not automatically determine the lawyer’s fee. Complexity and necessary actions matter. Reviewing the records allows the service, payment and process for expanding instructions to be agreed if additional episodes or another procedural stage arise.

Treatment expenses, non-pecuniary damage and compensation

Property-related claims require proof of actual expenditure and connection to the event. Prescriptions, receipts, invoices and payment records explain the amounts. Future treatment needs supporting grounds. Non-pecuniary damage concerns individual consequences; figures from another judgment do not transfer automatically. The lawyer identifies the appropriate form, stage and evidence for a claim, including matters that still require verification.

Parties discussing compensation should understand its subject, proof of performance and consequences. Payment does not automatically end every case regardless of classification. Lawful settlement possibilities depend on the actual proceedings. The defence assesses the basis of demands; the injured party receives advice about presenting them. An agreement should reflect real terms without replacing procedural steps required for the intended legal effect.

Medical records and legal classification

A treatment attendance note, sick leave certificate and forensic medical finding serve different purposes. Treatment duration alone does not determine a criminal provision. Medical criteria, causation and fault must be assessed; compensation also requires support for particular costs and consequences.

Frequently asked questions

Do days of treatment determine the criminal charge?

Not by themselves. Medical criteria, expert findings and other offence elements, including fault and causation, must be assessed. A sick leave certificate does not establish the legal classification.

Can compensation be claimed without every receipt?

Each claim and its available proof require separate assessment. We collect documents and other appropriate evidence. Missing some receipts neither automatically defeats every claim nor guarantees recovery.

Can a lawyer join after a notice of suspicion has been served?

Yes. Counsel can review the notice, available evidence and restrictions at that stage. Provide records of earlier actions: changing representatives does not automatically restore an expired procedural deadline.

Must I visit an office for an initial meeting?

The initial consultation can take place remotely. Authority, venue, timing and the procedurally permitted form of attendance are agreed separately for a specific investigative action or hearing.

Does the initial agreement include an appeal against conviction?

The agreement defines its scope. Investigation, trial and appeal may be separate instructions. Once a decision is received, arrange assessment of potential grounds and preparation of an appeal in time to meet the applicable deadline.
