REFUSAL TO CONDUCT STATE REGISTRATION OF PROPERTY RIGHTS A LAND PLOT

In case if the ownership of the land is not registered in the State Land Cadastre, the state registrar refuses to carry out the state registration, about which makes the corresponding decision.

 In the event of refusal to conduct a state registration, land owners should initially register the formed land plot on the basis of documentation on land management with the assignment of a cadastral number to it in the territorial bodies of the State Agency of Land Resources of Ukraine, and only then will it be registered ownership of it in the territorial bodies of the State the registration service of Ukraine or notaries (in the course of notarial acts).
 The applicant can either submit the necessary documents to the registration service independently or transfer such documents through the land authorities, who entered the information about the land plot into the State Land Cadastre.
 Also, the State Registrar may decide to refuse the state registration of a land plot in the following cases:
- inconsistency of the submitted documents with the requirements of the legislation;
- location within the boundaries of the land plot to be registered, other land plot or part thereof;
- the location of the land plot on the territory of the authority of another state cadastral registrar;
- the applicant's submission of the documents is not in full.
In such cases, the state registrar shall issue or send a decision to the applicant by registered letter with a description of the attachment no later than the next working day after the decision to refuse to make the information (changes thereof) to the State Land Cadastre.
