Crossing the border with a disabled person

Since the introduction of martial law in Ukraine, changes have been made to the rules for crossing the state border. In particular, we are talking about conscripts. In our country, this category includes, in particular, men aged 18 to 60. Men of the specified age group who, for example, accompany persons with disabilities, can legally cross the Ukrainian border. In this article, we will consider in detail how the border crossing with a disabled person is carried out. The legislative basis of the issue of crossing the border with a disabled person

The current Ukrainian legislation regulates the following: the crossing of the state border through the relevant checkpoint is carried out exclusively with a person who is accompanied by a conscripted spouse. That is, we are not talking about a man’s independent crossing of the state border. The only exception is a person with a disability who is already outside Ukraine. To do this, it is necessary to provide the inspector of the State Border Service with a certificate about the stay of a person with a confirmed disability on the register at the consulate of the state where he is located. In addition, it is also necessary to return to Ukraine only with the person whom you accompanied at the border. That is, the return of a person with a disability to Ukraine without an accompanying person is a direct violation of the current legislation. However, no specifics regarding the punishment for violating this rule are currently provided.

Documents needed to cross the border with a disabled person

In order to legally cross the state border with a disabled person, you will need an appropriate list of documents. All documents must be notarized.

Among the main documents:

  1. Certificate — confirmation of obtaining the status of “person with a disability”.
  2. Pension certificate indicating the group and reasons for establishing disability.
  3. A certificate on assigning benefits to a person with health problems.

The final list of documents depends on each specific case. Important: all documents must be prepared in accordance with current Ukrainian legislation. For example, if the documents assigning a person with a disability were made outside of Ukraine, it will be very difficult, almost impossible, to cross the state border.

If persons with established disabilities of the 1st group are accompanied, some benefits are provided when crossing the state border, for example, the possibility of crossing it in the first place. At the same time, there are no restrictions on how many times the border will be crossed.

Who can accompany persons with disabilities?

Persons with disabilities can be accompanied by persons who are not connected with special or military registration in the SBU, the Ministry of Defense, the Foreign Intelligence Service. These can be parents or guardians of a child with a disability, a spouse of a person with a disability, a close relative or another person.

Within 3 working days after crossing the state border, the National Social Service notifies the Ministry of Foreign Affairs. At the same time, the country of residence of the person with a disability and the accompanying person is indicated. In turn, after arriving in another country, the accompanying person should contact the representatives of the Consulate of Ukraine in the host country. The term is one working day. Persons with disabilities must register at the Consulate.
