Compensation for damage caused by the military aggression of the Russian Federation against Ukraine

Since 2014, the Russian Federation has been carrying out armed aggression against Ukraine, that is, it has committed actions defined by Article 3 of Resolution 3314 (XXIX) of the United Nations General Assembly of December 14, 1974, as an act of armed aggression. It was then that the processes of bringing the aggressor country to justice began to take shape, the damages it caused were recorded, laws were gradually changed in accordance with the new conditions, and Ukraine began to actively defend its position on the international arena, raising the issue of arrest, confiscation of Russian property and possible further compensation for damages.
Is it possible to get compensation for war damages?
After the beginning of the military aggression of the Russian Federation against Ukraine, numerous attacks on civilian infrastructure objects throughout the territory of Ukraine and from different directions, using ships, aviation, missiles and artillery, the democratic world realized that the issue of compensation for damages caused by military aggression is the largest since the Second World War war
Taking into account the above, statements, actions of our international partners, legislation, legal practice, laid the foundation for the possibility of compensation for material and moral damage, both for individuals and for businesses.
For what damage can you receive compensation in the amount of 35,000 euros or more?
The strikes of the Russian armed forces on residential infrastructure caused an increase in the number of cases of destruction and damage to the property of Ukrainian citizens who were under the attack of enemy troops. The loss of property or housing entitles every citizen of Ukraine to compensation in the amount of 35,000 euros, taking into account the norms of national and international law and court practice.
It should be noted that the first step of anyone who has suffered moral and material losses is to submit a statement about the commission of a criminal offense to the nearest department of the National Police of Ukraine as a result of the aggression of the Russian Federation.
In addition to the application, it is necessary to have a package of documents for further filing a lawsuit in court where the defendant will be the Russian Federation:
• Information certificate from the State Register of Real Property Rights (Register of Property Rights to Real Property, State Register of Mortgages, Unified Register of Prohibitions on Alienation of Real Property Objects, etc.);
• Act on property damage;
• State Emergency Service Act;
• Statement on the commission of a criminal offense, Extract from the EDPR on the opening of criminal proceedings, protocol of inspection of the scene of the incident drawn up by the pre-trial investigation body;
• The response of the SBU (regarding the establishment of the fact of bombing/rocket fire);
• Photographs, video recordings of property destruction/damage;
• Subcontract (regarding the performance of repair, construction, etc.) receipt for payment and acceptance-handover of works;
• Delivery contract (regarding delivery of goods necessary for performance of works) and payment receipt;
• Cashier’s checks (purchase of goods in stores, necessary for carrying out restoration work);
• Expert opinion on the causes and extent of damage, commodity receipts, contracts, statements of bank transfers, etc.
After submitting a statement about the commission of a criminal offense, collecting the necessary evidence, you must submit a statement of claim to the Ukrainian court.
