In the conditions of martial law, life in Ukraine has changed significantly.

At the same time, despite all the difficulties, people continue to build their relationships and plan a joint future. One of the important steps in creating a family is marriage registration.

How this process takes place in wartime, what features and nuances should be taken into account – this will be discussed in this article.

Peculiarities of marriage registration under martial law

Ukrainian legislation provides a number of simplifications for marriage registration during martial law.

In particular:

  • Accelerated deadlines: The marriage can be registered on the day of submission of the application or within one month at the choice of the bride and groom.
  • Cancellation of monthly waiting: In contrast to peacetime, there is no need to wait a month after submitting the application. Possibility of changing the date: In case of inability to appear on the scheduled day, the registration deadline can be postponed by written application.
  • Simplified procedure for military personnel: If one of the grooms serves in the army, the marriage can be registered without his personal presence.

It is also worth noting that according to the Family Code of Ukraine, brides and grooms have the right to independently choose the body of state registration of civil status acts for submitting an application.

That is, future spouses can submit an application for marriage registration in any department of the DRATS convenient for them.

To register a marriage in Ukraine, the bride and groom must submit the following package of documents to the Department of State Registration of Civil Status Acts (DRATSS):

  • Passports:

Passports of citizens of Ukraine (originals and copies).

For foreigners or stateless persons – passport documents or identity documents, as well as documents confirming the legality of their stay on the territory of Ukraine.

  • Identification codes:

Identification codes of both brides and grooms (originals and copies).

  • A document confirming the termination of a previous marriage:

If one of the bride and groom was previously married, it is necessary to present a certificate of dissolution of the previous marriage or a court decision on dissolution of marriage.

  • Application for state registration of marriage:

The application is filled out directly in the RAC or can be filled out online on the Diya portal.

  • Document on payment of state duty:

Receipt for payment of state duty for marriage registration.

Important points to consider:

  • Capacity: A person with a disability must have full civil legal capacity, that is, have the right to independently commit acts.
  • Fictive marriages: Unfortunately, there are cases when marriages with persons with disabilities are concluded for selfish reasons (for example, to receive social benefits or to avoid military service). Such marriages are illegal and can be declared invalid in a court of law.
  • Limitation of rights: Persons with disabilities have the same rights and obligations in marriage as other citizens. Their rights cannot be limited due to disability.

Registration of marriage in reduced terms

In conditions of martial law or under special circumstances, Ukrainian legislation allows registration of marriage in an accelerated manner. This means that the marriage can be registered not a month after the submission of the application, as it is usually provided, but in a much shorter time, even on the day of the submission of the application.

When it is possible to shorten the terms:

  1. Martial law: During martial law or in a war zone, marriage registration can be carried out immediately.
  2. Bride’s pregnancy: If the bride is pregnant, the law allows the marriage to be registered in a shorter time frame.
  3. State of health: In case of serious health condition of one of the grooms or other valid reasons, the terms can also be shortened.
