Private executor: requirements for a specialist

To begin with, we consider it necessary to explain how public contractors differ from private ones. Many scientists believe that it is wrong to distinguish performers only by sources of funding. Both public and private contractors are governed by current Ukrainian legislation. A state executor is formally a state employee. As for the private performer, he acts as a subject of independent professional activity. This is a person authorized by the state to carry out activities related to enforcement of decisions.

Fairly strict requirements are imposed on private contractors:

1. Age – 25+.
2. Education - higher law degree (master's degree and higher).
3. Professional work experience - more than 2 years.
4. Additional training. This can be an internship at an active state/private contractor or study at an accredited university. In addition, you will need to pass a qualifying exam.

Peculiarities of appeals to a private performer

Court decisions (resolution, resolution, court orders) can be implemented in two ways: voluntary and compulsory. If the debtor does not agree to comply with the decision voluntarily, the creditor must apply to the court for the issuance of a writ of execution. With this writ of execution, you can apply to a private executor. The term of presentation for enforcement is up to 3 years.

The main duty of every private executor is the execution of decisions made by the court. Private performers have the right to:

1. Free of charge to receive references, explanations necessary for executive actions.
2. Unhindered entry into residential/non-residential premises of the debtor, inspecting them (such actions are carried out on the basis of a court decision).
3. Register the encumbrance of the debtor's property.
4. To impose fines on the debtor.
5. Receive information about the debtor's funds and accounts from banking institutions.
6. Apply to the court for coercion of officials and individuals.

And this is far from a certain list of powers of a private executor.
