An important condition for activities in the field of gambling and lotteries for citizens is the presence of a license issued by the relevant Commission in accordance with current legislation, including a license for a gaming machine.

The absence of such a license is not only the basis for imposing a fine on the violator of the legal procedure for conducting the relevant activity in the amount of one thousand minimum wages, which as of May 2024 is 8,000,000 hryvnias (deducted for each gaming table used without a license for it), but and removal of gaming tables from use.

The gaming table license is divided into two types depending on the characteristics of the gaming table itself. In particular, the Gambling Regulatory Commission (hereinafter referred to as KRAIL) can issue licenses for the operation of a gaming table with a roulette ring (American/European roulette, etc.), as well as for the operation of a gaming table without such a roulette ring (poker and others).

We will analyze the main features of obtaining the specified licenses in the context of our current national legislation.

Requirements for a person to obtain a gaming table license

To date, a number of licensing requirements for a person wishing to obtain a gaming table license (both with and without a roulette ring) are defined.

Therefore, the person must:

• be a legal entity registered in Ukraine, the authorized capital of which is not less than three hundred minimum wages (as of May 2024 – 2,400,000 hryvnias);
• must have at its disposal the premises that meet the requirements of the legislation regarding the technical compliance of the activity, sanitary standards;
• have a manager and members of their own executive body who, according to the law, can engage in gambling business (for example, meet the requirements of business reputation).

Features of the relevant gaming table license

The specified type of license for conducting gambling games and lotteries has a certain number of features, which are expressed in its term of validity, annual fee, grounds for refusal to issue a license.

Let’s consider each aspect separately:

• Firstly, a gaming table license is issued for the term of the license for gambling activities in casino gambling establishments, which according to the current legislation is equal to 5 years.
• Secondly, the annual license fee for a gaming table (both with and without a roulette ring) is equal to one hundred seventy-five/ninety minimum wages for one gaming table, which is 1,400,000 hryvnias and 720,000 hryvnias in accordance.
• Thirdly, the main reasons for refusing to issue a gaming table license may be the following: the applicant’s identity does not meet the license conditions described above, the documents submitted by him are incomplete or improperly executed.

The procedure for obtaining a gaming table license

Let’s consider the stages of obtaining a license for a gaming table. In particular, in order to obtain such a license, the business entity must: apply to KRAIL with a complete and proper package of documents, and pay the set price of the license according to each type, determined by KRAIL.

Based on the results of consideration of the relevant application, KRAIL makes a decision on issuing/refusal to issue a license within thirty days.

It is worth paying attention to the current requirements for the list of documents that a person must submit to obtain a license for a gaming table (both with a roulette ring and without it).

They are the following:

• an application from a person to obtain a license of the established model;
• a scan copy of the founding document of the legal entity with all the necessary details (including a notarized notarization);
• a scanned copy of the certificate (excerpt from the UDR) on the state registration of a legal entity;
• documents confirming payment of fees and charges for the first year of license validity;
• documents confirming the legal entity’s right to own or use the premises in which the relevant activity will be carried out;
• additional documents that will need to be submitted to the applicant at the request of KRAIL.
