Certification of cosmetics (cosmetic products)

In accordance with the association agreement with the EU, Ukraine implements and coordinates legislative requirements, including in the area of product safety and quality for consumers. Thus, the Cabinet of Ministers developed and approved the Technical Regulations for cosmetic products, according to which a large list of products that were previously checked exclusively for compliance with sanitary and hygienic requirements must now meet much stricter requirements. The regulation enters into force already in August 2024, so all cosmetic products that are imported or produced in Ukraine must receive proper documentation by this time.

In Ukraine, the cosmetics certification procedure is regulated and carried out by the Ministry of Health of Ukraine.

In order for a cosmetic product to be introduced to the Ukrainian market and sold in Ukraine, it is necessary to confirm the compliance of the manufacturer and the products with the requirements of the Technical Regulations. At the same time, the tool must pass a mandatory safety assessment, have proper documentation for the warehouse, have a responsible person in Ukraine for such products, and also go through the notification procedure.

The cosmetics certification process includes:

• Formation of a cosmetic product file (determining the composition of the cosmetic product and its intended functions).
• Carrying out a number of studies and tests in order to determine the quality and safety of the product, its effect on a person
• Formation of a report on the safety of a cosmetic product
• Assessment of labeling and confirmation of compliance of labels with legal requirements
• Determination of the responsible person
• Notification of cosmetics in the Ministry of Health

Certification of cosmetic products in Ukraine is mandatory for all manufacturers, as well as importers who plan to sell their products in the country. Without a certificate, a cosmetic product cannot be supplied in the trade network, and the detection of products without proper certification can be completely withdrawn from circulation at the expense of such an importer or manufacturer.

In addition, it is assumed that the compliance of the cosmetic product with the requirements of the legislation and its safety is checked not only at the certification stage, but also during the quality control process of cosmetic products already on the market. At any time, the State Medical Service, which is designated by the state market surveillance body for cosmetics, may request a complete list of documentation from the Responsible Person, and in case of its absence, significant fines will be imposed on the distributor. Also, consumers have the right to demand from the manufacturer or seller of a cosmetic product a certificate of conformity, which confirms the safety and quality of the product.

Administrative sanctions are provided for violating the requirements of the legislation on the certification of cosmetics in Ukraine: for example, failure to inform the consumer about the risks of using the products carries a fine of 50,000 hryvnias, introduction of dangerous products into circulation – from 100,000 hryvnias, and failure to comply with the requirements of the State Medical Service to inform about dangerous products or the obligation to remove it from the market – up to 170 thousand hryvnias.
