REGISTRATION OF A TEMPORARY RESIDENCE PERMIT IN UKRAINE FOR CITIZENS OF NON-VISA COUNTRIES

In connection with the quarantine, when it became more difficult, and sometimes impossible, to cross the state border of Ukraine for quite understandable reasons, the question became urgent: ⟪ How to carry out the obligatory departure / arrival from the territory of Ukraine of foreign citizens of non-visa countries to change the purpose of the trip, who have reasons for obtaining a temporary residence permit in Ukraine? ⟫

 On October 9, 2020, based on the initiative proposal of the State Migration Service, the Cabinet of Ministers of Ukraine made a decision according to which the procedure for issuing temporary residence permits for foreign citizens of non-visa countries of certain categories was simplified.

From this moment, foreign citizens who, in accordance with laws or international treaties, are on the territory of Ukraine on a legal basis and are not required to obtain a long-term visa to enter Ukraine, in the case of acquiring grounds for obtaining a temporary residence permit in Ukraine, may not carry out a preliminary exit / arrival from the territory of Ukraine to change the purpose of arrival in Ukraine, and immediately - they acquire the right to submit documents and obtain a temporary residence permit.

 According to the Decision, citizens of non-visa countries have the right not to leave Ukraine to change the purpose of the trip, except for countries that are recognized by the VRU as aggressor or occupying countries.

 Foreign citizens who are not required to obtain a long-term visa for obtaining a temporary residence permit and have received a work permit for a foreigner or stateless person in Ukraine can apply for a residence permit in Ukraine within 30 days from the date of the last entry into the territory of Ukraine. This information is especially relevant for citizens of the Republic of Belarus who are IT specialists and have issued a work permit, as well as for their family members.

 Requirements according to the list of documents according to the category and processing time remained unchanged. And also, submission of documents for a temporary residence permit without prior departure remains possible no later than 15 working days before the "closure" of the corridor for legal stay in Ukraine.
