During the martial law in Ukraine, the procedure for medical and social examination was greatly simplified. But what to do if you have a need and need to appeal the decision of the MSEK?

There are two ways of contesting the conclusions of MSEK: extrajudicial and judicial.

If the patient does not agree with the conclusions of the medical and social expert commission, then such a decision of the MSEK can be appealed within a month. A complaint can be submitted to the commission that made the decision or to the central or regional commission. In order to verify the conclusions of the MSEC, a re-examination is conducted and a new decision is issued. In case of repeated disagreement with the adopted decision, it can be appealed to the Central MSEK of the Ministry of Health of Ukraine.

The judicial method of challenging the decision of the MSEK at any level is carried out by applying to the court with a statement of claim within the limits and in compliance with the requirements of administrative proceedings.
