Then Andriy Prikhodko made a speech on the topic of the Bureau of Economic Security, whose activities were launched in accordance with the relevant order of the Cabinet of Ministers.

"Will the bureau be a law enforcement agency and not just an analytical one with a law enforcement function as advertised?" - the lawyer asked a rhetorical question.

And neither among the fellow speakers nor among the lawyers in the audience of the institution was there anyone who would dispute the opinion that the mentioned Bureau will have the authority to work even harder than the divisions of the Federal Security Service, the SBU, and the National Police.

Bureau of Economic Security: Expectations VS Reality

Andriy Prikhodko analyzed the fact that the new strict norms of tax legislation become the basis against which the activities of the Bureau of Economic Investigations will have unfavorable formats for business. He cited as an example a new article on VAT refunds and increased sanctions for articles that provide for liability for tax evasion. And after that, he more carefully analyzed the structure of the aforementioned Bureau, where not only investigators and operatives are present, but also a unit of analysts. Against the background of increased tax law sanctions, these employees will have many powers.

The managing partner of our company also analyzed changes in the legal context. He noted that law enforcement agencies, which worked before the creation of the Bureau, "caught" offenders on a point-by-point basis. DPS and DFS were opponents, although they declare common goals. The State Fiscal Service did not have access to many databases of the State Tax Service. With the emergence of the Bureau of Economic Security, access to cashless movement of funds is being simplified. This unit deals with tax evasion schemes. His analysts have the appropriate analytical work, and after that, assignments for detective units. Thus, a new mechanism for investigation has been introduced.

Has anyone thought about business?

"Although lawyers will have more work, business will feel worse," noted Andriy Prikhodko. He noted that business needs security. Therefore, there should not be situations where property is searched and seized without any objective grounds, while the business suffers and cannot function normally.

Andriy Prikhodko concluded that the business seeks justice: if the lawyer proved that the search was illegal, then the damages should be compensated. If the business is waiting, in connection with the search, when the forced layoff ends, there should be an appropriate compensation. And such mechanisms are currently not foreseen.
