When it comes to indexation in pension matters, some mistakenly believe that it is simply an increase in the pension adjusted for inflation. In fact, it means an increase in the average salary, which is taken into account when calculating the pension.
Which persons are entitled to indexation of pensions?
The right to pension indexation belongs to all pensioners (working people are no exception) who have full insurance experience. Funds are provided in the state budget for a corresponding increase in pensions. The PFU’s own revenues are also directed to this. Several tens of billions of hryvnias will be directed to this task.
When we talk about the indexation of pensions for military pensioners, it is worth bearing in mind the relevant resolutions of the CMU:
- № 118 of February 16, 2022 “On indexation of pensions and measures to increase the level of social protection of the most vulnerable segments of the population in 2022”;
- № 168 “On the indexation of pension and insurance payments and additional measures to increase the level of social protection of the most vulnerable segments of the population in 2023.”
If you turn to the lawyers of the “Prikhodko&Partners” law firm for advisory support, you will receive a detailed analysis of the norms of the mentioned legal acts with the correct emphasis on their application in your particular situation.
Pensions will be increased by 14 % in 2022. And in 2023, this indicator became higher by 19.7 %. It is significant that Clause 10 of Resolution № 168 provides: when the pension is recalculated, the amount of the increase should not exceed 1,500 hryvnias.
When does a problem arise with the payment of a pension with indexation?
There are cases when indexation is calculated, but not paid out. For example, this applies to persons who receive the maximum amount of pension (as of this year, it is 20,930 hryvnias). This also includes persons who were able to defend their right to a pension through the court without limiting it to the maximum amount.
However, such situations are not hopeless. Court practice shows that they can be resolved quite positively, because such cases are profitable. And according to the results of the review, the Pension Fund will be forced to pay the pension in full.
