WHY IS IT NECESSARY TO LEGALIZE ILLEGAL CONSTRUCTION IN 2020?

 In 2020, a construction amnesty will continue in Ukraine. According to paragraph 9 of section V of the Law of Ukraine "On Regulation of Urban Development", it applies to facilities up to 300 square meters, which position themselves as class CC1, built in the period from August 5, 1992 to April 9, 2015. These are: private houses, cottages, gardens, outbuildings, as well as agricultural facilities, erected no later than March 12, 2011.

 This means that you can legalize self-construction without paying a fine under a special procedure. According to the procedure, certain conditions must be met:

• the object must be built on the site with the intended purpose;
• there must be documents for the right to use or own land;
• the plot must have a cadastral number;
• the building must be built in compliance with building codes, as confirmed by a specialist.

Required documents

The owner must prepare the following documents:

• passport;
• identification code;
• a document on the right of ownership or lease of land;
• construction project (if available);
• technical passport (if available);
• certificate of membership in the garden cooperative indicating the year of construction, if the house is in a garden cooperative.

Stage one: preparation of technical passport.

Stage two: registration of the declaration of completion of construction.

Stage three: registration of property rights.

Why is it necessary to legalize self-construction?

The main reasons for which it is necessary to legalize self-construction:

• violations of construction legislation entail fines of various amounts;
• self-built can not be sold, donated, exchanged, as it has no title documents;
• there is no possibility to connect communications, for various services permits for construction and readiness of object for operation are necessary.
