WHO IS ENTITLED TO DEAD MILITARY PAYMENTS?

Service in the Armed Forces is not only an honorable duty of citizens to protect the Motherland, but also a daily risk. Unfortunately, no one is guaranteed to return alive. One-time assistance in the amount of 15 million hryvnias is provided in accordance with Cabinet Resolution № 168 of February 28, 2022.

What other help is provided?

In addition to the one-time benefit mentioned, family members can receive burial benefits. These funds are paid by the military unit and are 5 subsistence minimums in accordance with Government Resolution № 829 of May 22, 2000. There is also a normative legal act that provides for an identical payment in the event that the soldier did not die, but died while serving. This refers to Cabinet Resolution № 975 of December 25, 2013.

Who receives benefits in connection with the death of a serviceman?

The list of these persons is referred to in Art. 161 of the Law of Ukraine "On social and legal protection of military personnel and their family members". Therefore, the payment is divided equally between:

  • parents of the deceased;
  • one of the spouses, if such a person has not remarried;
  • children under the age of 18;
  • adult children who are full-time students, if they are not older than 23 years;
  • children older than 18 years who have a disability;
  • dependents of the deceased.

Thus, the legislation regulates everything in detail. However, in practice, there are often problems with receiving the payment and its fair distribution.
