In Ukraine, from May 18, 2024, the following categories of citizens are not subject to mobilization, namely

  1. Persons liable for military service who have an official spouse with existing health problems and disabilities of the first or second group;
  2. persons liable for military service who have an official spouse with a disability of the third group, which was established due to the existence of various oncological diseases (cancer of the skin, liver and other organs, the presence of malignant tumors in the human body, etc.), the absence of limbs (limbs), hands (hands), feet (feet), one of the paired organs (lungs, eyes, kidneys, etc.), mental illnesses, etc.

In addition, if a person liable for military service is engaged in constant care of a sick spouse, he or she is also not subject to mobilization for the period of martial law in the country. Thus, the presence of different disability groups (1, 2, and 3) in a spouse entitles a person to a deferment of mobilization.

How can I get a deferment of mobilization if my wife has a disability and what documents may be required for this?

In practice, in order to obtain a deferment of mobilization for the period of martial law, a person liable for military service must apply to the territorial TCC and JVs with a written application for a deferment. The application must be accompanied by a set of documents confirming the legal grounds and the person's right to deferment, namely

  • documents confirming the wife's current disability - a certificate from the MSEC, a specialist's opinion, an extract from the medical record of an outpatient (inpatient) patient
  • documents confirming family relations - a marriage certificate.

It is worth noting that such an application can be submitted both by mail and in person.
