What to do if they do not sign the dismissal report?

In order to be released, a serviceman must write a report and confirm the circumstances stated in it with relevant documents. Therefore, the report gives the military an opportunity to exercise their will and protect their rights and interests. However, unfortunately, the process of reviewing the report can be delayed or ignored altogether.

Refusing to accept this report from a serviceman is quite a popular phenomenon. So what to do if the dismissal report is not even signed? You can solve this issue yourself or seek help from a lawyer.

One of the ways is to send the report by a valuable letter with a description with a notice of delivery to the military unit and indicate the address to which you want to receive an answer regarding the consideration of the report.

If the report was accepted, but is ignored, the process is delayed and not considered, you can contact a lawyer who, by sending a lawyer's request, will find out whether the report has been considered or not, and if it has been considered, what are the results of its consideration. If the report has not been considered, then ask to be informed why the right to be dismissed from military service provided for by the Law of Ukraine "On Military Duty and Military Service" is being ignored and when the said report will be considered and to be informed when the serviceman in whose interests the application was made will be dismissed from military service appropriate lawyer's request.

According to Art. 19 of the Law "On Social and Legal Protection of Servicemen and Members of Their Families" provides for the right of a serviceman to appeal illegal decisions and actions (inaction) of military administration bodies and commanders (supervisors), which may be appealed by servicemen in the manner prescribed by laws and statutes of the Armed Forces of Ukraine and other normative legal acts.

Do you need to make a verbal or written complaint?

Complaints can be both oral and written. But it is better to submit everything in writing so that there is always confirmation of your actions.

Where to file a complaint?

The relevant authorities for addressing problems with the review of reports are:

• Ministry of Defense of Ukraine: you can make a verbal complaint to the hotline, or to an e-mail or postal address;
• Command of the Ground Forces of Ukraine, sending this complaint to the postal address;
• The operational command of the relevant region to which your military unit belongs, sending this complaint to the postal address.

In general, as regards complaints, it is also possible to send them to the military service of law and order and structural divisions of the Specialized Military Prosecutor's Office. Also, there is an opportunity to contact the Commissioner of the Verkhovna Rada of Ukraine for human rights.
