Due to the intensification of mobilization measures in Ukraine, in practice, cases have become more frequent when citizens liable for military service discover that they are wanted due to a violation of the current rules of military registration, and therefore they need to immediately appear at the district CCC and SP to clarify their military registration data and be removed from the wanted list. As a rule, individuals learn about these circumstances during the verification of their documents by law enforcement agencies, by visiting the service centers of the Ministry of Internal Affairs or district military registration offices, when crossing the state border, etc. Therefore, in this information article we will talk about what to do if the military registration office has put a citizen on the wanted list?

 

What should be understood by the TCC and JV wanted list?

The TCC and JV wanted list is a legal status that citizens liable for military service acquire in connection with a violation of the rules of military registration established by current regulatory legal acts. For example, these may be the following violations committed by citizens:

  • receiving a properly delivered summons “in person” and failing to appear at the TCC and JV on the specified date and time;
  • informing a person against signature at the workplace that it is necessary to arrive at the local military registration office (usually carried out by the immediate supervisor);
  • receiving a summons by mail and failing to appear at the TCC and JV;
  • untimely updating military registration data (until July 16, 2024);
  • not being on military registration at the TCC;
  • and many others.

Thus, as a result of violations of the rules of military registration, the military registration office may initiate the procedure for declaring a person wanted in accordance with current legislation.

Please note! The RTCC and JV in Ukraine do not have the authority to independently declare citizens liable for military service wanted, since only law enforcement agencies (usually the National Police) are vested with such authority.

Therefore, the TCC first contacts these bodies and reports that the person is evading military registration during the period of martial law, and only then do they take appropriate measures to declare the person wanted (open criminal proceedings and enter information into the ERDR). Only after this can the citizen be delivered to the TCC and the SP with the use of force.

In practice, when putting a person on the wanted list to the TCC, you need to follow the following algorithm of actions:

  1. Find out the reasons for the wanted list. This is the first step in which you need to find out for what specific actions the citizen was put on the wanted list. If a person conscientiously follows the rules of military registration and has updated his military registration data in a timely manner, he may have been mistakenly put on the wanted list, and therefore these circumstances should be clarified in practice;
  2. Contact the district TCC. If a citizen subject to military service did not receive any summons to appear at the TCC, but was still put on the wanted list, then he should appear at the TCC and the JV at the place of residence of the person. Already on the spot, the citizen will be able to obtain all available information about the wanted list and whether he is threatened with prosecution;
  3. Contact the judicial authorities. If a citizen believes that his wanted list is an illegal action by law enforcement agencies or the military registration and enlistment office, then they must be appealed. To do this, you should apply to the local court of first instance with a corresponding application to appeal the decision to declare a person wanted.

How can you avoid being wanted?

  • Comply with the legislation of Ukraine. The best way to avoid being declared a wanted person is to comply with all the rules of military registration, as well as timely respond to the need to appear at the TCC and the JV upon a summons or in order to update military registration data. In addition, you should notify the district military registration and enlistment office in advance of a change of place of residence and always have all available military registration documents with you;
  • Get help from lawyers.
