What is the procedure for registration of permanent care for persons who need it in the conditions of martial law and taking into account the changes made to the legislation ?

On June 30, the President signed the Law of Ukraine " On Amendments to Certain Legislative Acts of Ukraine Regarding Certain Issues Related to Military Service During Martial Law " dated June 28, 2023. No. 3161-IX ( draft law No. 9342).

How does this relate to the registration of permanent care for persons with disabilities and persons who need it according to the conclusion of the medical advisory commission?

In the resolution of the Cabinet of Ministers of Ukraine No. 859 dated 23.09.2020, no changes were made regarding the appointment and payment of compensation to individuals who provide social care services on a non-professional basis, therefore the procedure for registering permanent care has not changed.

However, the formation of permanent care for persons who need it seems to be a difficult and incomprehensible process.

Therefore, it is necessary to clearly understand who has the right to provide such care and which persons need it.

Today we will talk about the submission and processing of documents, assignments, and payment of compensation to individuals who provide social care services on a non-professional basis.

Persons who have the right to provide care on a non-professional basis are relatives who live with a person who needs care, have a common life, mutual rights and obligations and help in everyday life.

People who need such care can be elderly people with limited independence, people with disabilities, patients with chronic diseases, or people with special needs.

Establishing permanent care for such persons is an extremely important and necessary procedure to ensure their well-being and quality of life.

Continuous care is necessary to ensure the quality of life and well-being of persons who cannot take care of themselves due to health, age, or special needs.

Continuing care helps ensure the safety and comfort of those who need it, including assistance with daily needs, organizing personal hygiene, and providing psychological support.

It is important to note that the specific terms and procedures for registration of permanent care may differ depending on the legislation and regulations in force in different regions of Ukraine.

The specific term of registration of permanent care can be determined by medical experts, the commission on the assignment of care, and social services, taking into account the needs and circumstances of each specific situation.

What is the help of lawyers in the process of formalizing permanent care?

The role of a lawyer in arranging permanent care for persons who need it is extremely important and useful.

A lawyer can provide professional legal support and advice that helps ensure the rights of people who need constant care .

Here are some ways a lawyer can help :

  • Legal advice: A lawyer can help people who need constant care and their families to understand their rights and responsibilities. They can explain the continuing care process, clarify legal terms, and determine possible options for action.
  • Preparation of documents: A lawyer can assist in the preparation of all necessary legal documents for ongoing care, such as statements, certificates, medical reports, etc. They can ensure the correct wording and fulfillment of all legal requirements and help in filling out forms to avoid possible errors.
  •  Representation and protection of rights: A lawyer can act as a representative of a person who needs care in relation to social security bodies, medical institutions, and other relevant organizations.
  •  Legal analysis: A lawyer can conduct a legal analysis of a specific situation related to ongoing care and determine the best approach to protecting the rights of the person who needs it. They can research legislation, rules, and regulations relating to care and make the necessary recommendations.
  • Mediation and negotiations: A lawyer can act as an intermediary between a person who needs care and the relevant authorities or parties. They can help resolve disputes or conflicts, establish contractual terms, and reach a compromise that satisfies the interests of all parties.
  • Monitoring and updating: A lawyer can monitor the situation and provide updated legal information about changes in legislation, rules, and procedures related to continuing care. They can monitor compliance with agreed terms and provide additional support as needed.

Establishing permanent care for persons who need it can be a complex and legally important process.

Lawyers are uniquely placed to provide legal protection and support to people in need of care and their families.

They can help with all aspects of registration, represent and protect rights and perform all necessary legal procedures, contributing to the harmonious and efficient provision of ongoing care.
