What is the penalty for driving without a license?

Every driver of a vehicle must have a driver's license with him when driving it, which confirms the ability to drive a car.

What determines responsibility for driving a car without a driver's license?

Currently, Ukrainian legislation determines that in cases of driving a car by a person who does not have a driver's license, imposing a fine.

This is stated in Art. 126 of the Code of Criminal Procedure, which establishes the existence of administrative responsibility for citizens.

What are the fines for Art. 126 KUpAP in 2024?

The disposition of Art. 126 of the Code of Criminal Procedure provides for liability for driving a vehicle by a citizen who does not have the appropriate documents for this (this should include a driver's license, registration documents, and car insurance policy), or who did not present them for inspection to an authorized person (usually employees of the National Police), or regarding who has a temporary restriction on the right to drive a car, or was deprived of the right to drive a car, or if he committed such an offense repeatedly within 1 year.

Depending on the part of Art. 126 of the Criminal Procedure Code and the amount of the fine will depend on:

• if a citizen drove a car without the necessary documents (driver's license, registration documents, and car insurance policy) or their electronic equivalents, then a fine of UAH 425 is provided (Part 1, Article 126 of the Criminal Procedure Code);
• if the employees of the National Police discover that the citizen (driver) does not have a driver's license at all, allowing him to drive a vehicle, then a fine of UAH 3,400 is provided. (Part 2 of Article 126 of the Code of Administrative Offenses);
• if the employees of the National Police discovered that the citizen (driver) was deprived of the right to drive a car, then in this case a fine of UAH 20,400 is provided. (Part 4 of Article 126 of the Code of Criminal Procedure).

Pay attention! If a person has been imposed a temporary restriction on the right to drive a car, then the fine does not apply to him, since the sanction of Part 3 of Art. 126 of the Code of Criminal Procedure provides that in such a case the person is deprived of the right to drive a car for a period of 3 to 6 months.

Regarding repetition of the fact of the offense committed, it is worth noting the following. If within 1 year the driver has been prosecuted under Part 2-4 of Art. 126 of the Code of Criminal Procedure, then a sanction in the form of a fine is applied to it, which amounts to UAH 40,800. and the person is deprived of the opportunity to drive a car for a period of 5 to 7 years.

In addition, the vehicle may also be confiscated from the offender.
