What is the liability for forging a signature?

A forged signature creates the risk of significantly affecting the validity of contracts, banking agreements, notarial documents, and powers of attorney. Such an act is classified as falsification of official or private documents through which a person may obtain property or organizational benefits.
Understanding the concept of a “signature”
A signature is an element of identification that confirms the authorship of a specific action or document. The law defines signature forgery as a type of document falsification, which involves creating a falsified information carrier that gives the impression of genuine expression of intent. If another person imitates a signature, this constitutes a crime under Article 358 of the Criminal Code of Ukraine:
“Forgery of a document, seal, stamp or form, as well as sale or use of forged documents, is punishable by a fine, restriction of liberty, or imprisonment…”
This provision clearly shows the legislator’s position: any interference with the authenticity of official documents is illegal and entails criminal liability.
Types of signature forgery and typical qualification methods
In legal practice, signature forgery is one of the most common types of falsification. Lawyers distinguish several main categories of such offenses:
- Reproducing another person's signature to execute a contract. This occurs when a signature is forged to conclude a legally significant document without the knowledge of the actual owner. This allows obtaining property, financial, or other benefits unlawfully.
- Forgery of an employee's signature in HR or financial documentation. This is done within an organization to falsify timesheets, reports, payroll records, or accounting documents. The goal may be to conceal violations, obtain unlawful payments, or abuse authority.
- Copying a signature to obtain credit obligations. This is used to unlawfully obtain loans, credits, or other financial commitments in the name of another person.
- Forgery of signatures on notarial documents. This is the most serious type of forgery, as such documents confirm property rights or other legal rights. It may have long-term consequences for property and legal relations.
The crime may be classified cumulatively if the forgery is a method of committing another offense — for example, fraud, abuse of authority, or using false data for registering property rights. The court takes into account: the method of imitation, the extent of consequences, and the presence of intent. Signature forgery often accompanies financial fraud, so multiple articles of the Criminal Code may apply simultaneously.
Liability for signature forgery
Ukrainian legislation provides several levels of punishment depending on the severity of the offense and its consequences:
- Fine — applied in cases where the forgery did not cause significant harm. The amount depends on the circumstances, intent, and damages.
- Restriction of liberty — imposed when the falsification poses a higher level of danger, interferes with the functioning of institutions, affects civil or administrative processes, or violates citizens’ rights.
- Imprisonment for up to 2 years — applies to more serious acts involving the production or distribution of forged official documents used for unlawful gain.
If the forgery is combined with fraudulent appropriation of property, deposits, vehicles, or other assets, the penalty may increase due to additional qualification under Article 190 of the Criminal Code of Ukraine (fraud).
