Unauthorized construction has long become a common phenomenon in Ukraine. According to statistical data, every second building is erected in violation of current Ukrainian legislation.

What is unauthorized construction?

According to Article 376 of the Civil Code of Ukraine, self-build is a real estate object that was built on a plot of land not intended for these purposes, as well as without a project and relevant permit documents.

It is forbidden to put self-build into operation. What does it mean? A house that was built in violation of current legislation cannot be gifted, mortgaged or sold. Such real estate is not subject to state registration. Legalization of illegal buildings is a very complicated and lengthy process. In most cases, the legalization of the building exceeds the costs of obtaining the necessary permits.

What are the penalties for unauthorized construction?

Administrative responsibility is assumed for arbitrary construction, as well as for arbitrary occupation of land. We are talking about fines. In particular, they plan to add an article on the temporary arrest of self-builders to the Code of Ukraine on Administrative Violations.

If construction work is performed without submitting documents to the relevant authorities, this entails the following fines:

  • From 250 to 350 tax-free minimum incomes of citizens (it is planned to increase fines to the equivalent of 1000-1500 tax-free minimum incomes of citizens).

If the specified amount is not paid on time, the building may be demolished. In accordance with Article 376 of the Civil Code of Ukraine, the owner of a self-imposed building does not have any rights to this housing. That is, the right of ownership of the established house or other real estate does not belong to anyone.

Article 97 of the Code of Ukraine on Administrative Violations deals with serious violations of building construction rules.

Important: fines for self-construction are also imposed in the absence of official commissioning of the building.
