We make changes to the list of works for a construction license. What you need to know.

In accordance with clause 15 of the Licensing Procedure for Economic Activities Associated with the Creation of Architectural Objects, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 05.12.2007 No. 1396 (hereinafter referred to as the Licensing Procedure), the list of works is decided by the licensing authority adopted on the basis of a written or electronic form appeals of the applicant are subject to change. The question of amending the list of works is considered according to the Licensing Procedure, that is, by analogy with the procedure for reviewing an application for obtaining a license.

The application form for amending the List of Work Types (by supplementing and / or reducing) is defined in Appendix 6 to the Licensing Conditions, approved by Resolution of the Cabinet of Ministers of Ukraine of 03/30/2016 No. 256.

The application for amendments to the list of types of work is attached:

the original license with the application (in the case of a decision to amend the list of works, the licensing authority approves these changes and draws them up as a separate application, which is noted on the license form);
information about the production and technical base, the composition of workers by professional and qualification level, production technology, information and legal support, the existing system of quality control of work performed by the construction and installation works performed by the applicant in accordance with Appendix 2 to the Licensing Conditions;
the list of documents attached to the application, in accordance with Appendix 3 to the License Terms.
It should be noted that in accordance with the Law of Ukraine “On Licensing Types of Economic Activities”, if the licensee intends to expand production, the type of economic activity indicates the type of economic activity to which he intends to expand his activities. If the licensee intends to narrow the implementation of the type of economic activity, a statement on the restriction of the production of this type of economic activity indicates the type of economic activity to which he intends to narrow his activities. Practical application of this norm shows that the optimal form of the List of types of work in the application (to which the applicant intends to supplement and / or reduce the current list) is to present it in a new edition, taking into account the current List of types of work license and the licensee’s intentions on its addition and / or reduction .

In accordance with clause 15 of the Licensing Procedure, in the event a decision is made to amend the list of works, the licensing body approves these changes and draws them up as a separate application, which is indicated on the license form.

The timeframe for consideration of the application for amending the List of types of work is up to 27 working days. The fee for making changes to the List of types of work is supplemented by supplementing how to obtain a new license in accordance with the first part of Article 14 of the Law on Licensing, namely, in the amount equal to the subsistence minimum for able-bodied persons.
