Wanted by the Military Registration Office - consequences

Being wanted by the police and the military registration office can have a number of practical consequences for a person liable for military service.

First of all, there is a risk of being detained by police officers with subsequent delivery to the Military Registration Office to clarify the circumstances and fulfill the requirements of military registration. In addition, difficulties may arise when applying for certain state services, where the relevant registers are checked.

For officially employed persons, an additional factor is interaction with the employer: the company may serve a summons and demand that military registration documents be brought into proper condition; it is impossible to book a person who is wanted, with certain exceptions.

The procedure for declaring a person wanted by the Military Registration Office

Declaring a person wanted by the Military Registration Office and the Military Registration Office should not take place automatically, but within the framework of a clear procedure.

Firstly, the basis is the commission of an administrative offense in the field of military accounting (Articles 210, 210-1 of the Code of Administrative Offenses).

Secondly, after detecting a violation, the military registration and enlistment office forms an appeal to the National Police indicating the person's data, the grounds and the need for his administrative detention and delivery. The transfer of information is carried out electronically through state registers.

Thirdly, it is the police that enters the relevant information into the databases and, if there are grounds, carries out the detention with the subsequent delivery of the person to the TCC. It is important to consider that the detention is carried out exclusively by authorized bodies and in compliance with the established procedure - with the drawing up of a protocol, recording and notification of relatives or a defense attorney.

Payment of a fine

This is one of the most common ways. If the TCC has issued a resolution, a person can pay a fine, but quite often the payment itself does not guarantee automatic exclusion. After that, it is usually necessary to additionally appear at the TCC, update data or fulfill other requirements of military registration. In fact, paying a fine confirms the commission of a violation, but does not “close” the issue completely.

Appeal in court

If a person is included in the wanted list without issuing a resolution on an administrative offense or there are other procedural violations, such actions can be appealed.

Missing the deadlines for bringing to justice

The law establishes a limited period for imposing a fine: within 3 months from the moment the violation is detected (but no later than 1 year from the date of its commission).

If after the conscript is included in the wanted list within this period, a resolution is not issued, this creates grounds for appealing it.
