VIOLATION OF THE PERIOD OF STAY ON THE TERRITORY OF UKRAINE

Reading time: 3 min.

The rules for the stay of foreigners in Ukraine are clearly regulated by the current legislation. This was also the case in peacetime, and the stay of foreigners on the territory of Ukraine during the war is also determined by current legal acts. For example, a fine is provided for exceeding the period of stay on the territory of our state. If such an offense has occurred, then responsibility for it follows, in accordance with Article 203 of the Code of Administrative Offenses.

Violation of the rules of stay of foreigners in Ukraine: what the law provides?

According to the aforementioned article of the Code of Ukraine on Administrative Offenses, foreigners or stateless persons who have violated the period of stay determined for them in our country can either be returned to their country of citizenship or a third country, or deported.

In case of return, such a person may be prohibited from entering the territory of Ukraine for 3 years. If a person does not comply with this decision, he can be expelled. And then the ban on entry to Ukraine can reach 5 years.

To prevent this from happening, you should not wait until the last minute and contact good lawyers who will help extend the period of stay of foreigners in Ukraine. For example, our team includes specialists who undertake legal support for similar issues.

When it is possible to legally extend such a period?

Current legislation provides for several such grounds at once. For example, you can submit an application to ask for permission to immigrate. It can also be a statement that you intend to acquire Ukrainian citizenship. If the mentioned reasons are not relevant for you, there is another option - the presence of reasons that do not allow you to leave the territory of Ukraine. It may be:

  • pregnancy;
  • the need to care for a sick relative;
  • the need for treatment on the territory of Ukraine;
  • registration of inheritance;
  • performance of official duties by a foreign journalist.

In such cases, it is possible to extend the period of stay of foreigners on the territory of our country. Therefore, you should not wait for this period to expire by itself and it will be more difficult to change the situation. It is better to immediately enlist the professional support of good lawyers who will help you defend your interests.

Are there grounds for refusing to extend such a term?

Indeed, such grounds are specified in the legislation. For example, when the stay of a particular foreigner is against the national interests of our country or when he has forged documents. There are also some other reasons that our experts will tell you about.

However, it is worth remembering: if you are a law-abiding person and have objective reasons for extending your legal stay in Ukraine, this can be achieved in the vast majority of cases. Therefore, do not wait for the deadline to pass and apply for high-quality legal support in time.
