Violation of road safety rules or transport operation under Article 286 of the Criminal Code of Ukraine

Road traffic accidents (RTA) are one of the biggest threats to the safety of citizens and society as a whole. In Ukraine, liability for violation of road traffic safety rules or transport operation by persons driving vehicles is provided for in Article 286 of the Criminal Code of Ukraine (CCU). This article regulates the criminal liability of drivers for causing harm to life, health and property as a result of violating traffic rules (SDR).

The main conditions of application are that a road accident is considered a criminal offense if harm to health or life of people is caused and if the violation of the SDR did not lead to serious consequences, liability may be administrative.

If we talk about the composition of the crime, then Article 286 of the Criminal Code of Ukraine provides for three main components that define the crime:

  1. The object of the crime is public relations in the field of road safety and the operation of vehicles, as well as the life, health and property of citizens.
  2. The objective side is a violation of traffic rules or the rules for operating a vehicle, which led to the infliction of damage.
  3. The subject of the crime is the person driving the vehicle (driver).
  4. The subjective side is the presence of a negligent form of guilt, that is, the driver did not want, but due to negligence or frivolity allowed negative consequences.

Violation of road safety rules or transport operation under Article 286 of the Criminal Code of Ukraine

Article 286 of the Criminal Code of Ukraine is divided into three parts depending on the severity of the consequences:

Part 1. Causing a road accident that caused moderate bodily harm.

  • Punishment: a fine of up to 3,400 hryvnias, arrest for up to six months, or restriction of liberty for up to three years with deprivation of the right to drive a vehicle for up to three years.

Part 2. Road accident that caused serious bodily harm or death of the victim.

  • Punishment: imprisonment for a term of three to eight years with deprivation of the right to drive a vehicle for up to three years or without such.

Part 3. Road accident that caused the death of several people.

  • Punishment: imprisonment for a term of five to ten years with deprivation of the right to drive a vehicle for up to three years.

The investigation of a road accident under Article 286 of the Criminal Code of Ukraine is conducted by the investigative bodies of the National Police of Ukraine. The main stages include:

  1. Inspection of the scene. Establishing the circumstances of the accident, collecting evidence, including witness statements, brake tracks, and video camera recordings.
  2. Expertise. Ordering forensic, automotive, and other expert examinations to determine the causes and consequences of the accident.
  3. Interrogating the driver and witnesses. Clarifying the details of the incident.
  4. Conclusion on the cause and effect relationship. Establishing whether the driver’s violation of traffic rules was the direct cause of the negative consequences.

The main causes of road accidents that lead to criminal liability are:

  • Speeding. Failure to comply with speed limits is one of the most common violations.
  • Drunk driving. Alcohol or drugs significantly reduce the driver's reaction and ability to make the right decisions.
  • Violation of maneuvering rules. Improper overtaking, failure to maintain distance, etc.
  • Violation of pedestrian crossing rules. Ignoring pedestrians or signaling devices.
  • Non-compliance with the technical condition of the vehicle. Using a vehicle that does not meet safety requirements.

Violation of road safety rules or transport operation under Article 286 of the Criminal Code of Ukraine

In the event of an accusation under Article 286 of the Criminal Code of Ukraine, the driver has the right to defense. The main aspects of defense include:

  • Evaluation of evidence. The lawyer checks the validity of the accusation, the correctness of recording the evidence.
  • Establishing the circumstances of the incident. For example, whether the actions of the victims (pedestrians, other drivers) were the cause or accompanying factor of the accident.
  • Appealing the results of the examinations. In the event of unreliable or biased conclusions, the lawyer may require a re-examination.
  • Taking into account mitigating circumstances. Sincere remorse, voluntary compensation for damages, etc.

Mitigating circumstances include: sincere remorse; providing assistance to victims after the accident; voluntary compensation for the damage caused.

Aggravating circumstances include: driving while intoxicated; leaving the scene of the accident; committing an accident while speeding or other gross violations of traffic rules.

In order to prevent accidents, it is necessary to:

  • Strengthen control over compliance with traffic rules. Install automatic cameras to record violations.
  • Strengthen responsibility for driving under the influence of alcohol. Tougher sanctions can become a deterrent.
  • Driver education. Conduct educational campaigns on the consequences of traffic violations.
  • Improve infrastructure. Install high-quality road signs, traffic lights, and arrange crossings.

Article 286 of the Criminal Code of Ukraine is an important tool for ensuring road safety and holding accountable those who violate the rules and cause harm to others. At the same time, it is important not only to punish the guilty, but also to create conditions to minimize the risks of traffic violations. Compliance with traffic laws and regulations is the key to the safety of all road users.
