Using Registry Information

The procedure for providing information from the State Register of Rights is governed primarily by Art. 32 of the Law of Ukraine "On state registration of rights to real estate and their encumbrances" and the procedure for providing information from the State Register of Rights to Real Estate, approved by the decree of the Cabinet of Ministers of Ukraine of 12/25/2015 No. 1127. At the same time, both information from the registry and about who received such information (in this case, such information is provided only to the copyright holder).

In accordance with Article 32 Providing information from the State Register of Rights 1. Information on registered rights to real estate and their encumbrance contained in the State Register of Rights is open, publicly available and paid, except as provided for by this Law. 2. For individuals and legal entities, information on the immovable property and the subject of real right is provided in electronic form through the official website of the Ministry of Justice of Ukraine, subject to the identification of such a person (physical or legal) using an electronic digital signature or other alternative means of identification, or in paper form by the state registrar. Information on registered rights and their encumbrances obtained in electronic or paper form using the software of the State Register of Rights having the same legal force and is used in accordance with the law. Information from the State Register of Rights is not provided to individuals and legal entities in the event of failure to pay fees for providing information or making it in full. The procedure for providing information from the State Register of Rights is determined by the Cabinet of Ministers of Ukraine. 3. For officials of state authorities, local governments, courts, the National Police, prosecutors, the Security Service of Ukraine, the National Bank of Ukraine, the National Anti-Corruption Bureau of Ukraine, the National Agency for the Prevention of Corruption, lawyers, notaries, information from the State Registry rights in connection with the exercise of their powers, determined by law, is granted by the subject of the right or for an immovable property in an electronic form by direct access to the Derivative Register of Rights, subject to identification of the official by means of an electronic digital signature. The procedure for access to the State Register of Rights is determined by the Cabinet of Ministers of Ukraine. 4. According to the statement of the owner or other rightholder, the state registrar provides information on the persons who received information about the registered rights to real estate, they will, and encumbrance of such rights. At the request of an official of the pre-trial investigation authority in connection with the exercise of his authority as defined by law, the state registrar provides information in the relevant criminal proceedings in the form of an extract about the persons who received information about the registered rights to Obtain information can be made for a fee, the amount of which is specified in paragraph 2 Decisions of the Cabinet of Ministers of Ukraine dated 12.25.2015 No. 1127.

 The legislation provides for the possibility of obtaining information both in electronic and paper form, obtaining information in paper form is devoid of almost any sense, because according to paragraph 2 of the procedure for providing information from the State Register of Rights to Real Estate, information in paper form is provided on A4 paper without the use of special forms, the signing and printing of the state registrar.
