Transition to the pension of the deceased husband of a military pensioner

Reading time: 3 min.

Ukrainian legislation in the field of pension provision is regularly transformed. This especially applies to the issue of military pension. Let's consider in more detail the procedure for the transition to a pension of a deceased man who was a military pensioner. And we will also focus on what changes in legislation have taken place recently. In conclusion, let's find out what the team of our law firm can help with.

What are the conditions for awarding such a pension?

If it is the wife of the deceased, she is entitled to his military pension when he died or during the period of service, or no later than 3 months from the moment of this period. There may be exceptions in those situations where this period has passed, but the cause of death was a disability, illness or injury that the person received while in the military. It is also important that the wives of military pensioners have the right to such a pension for the loss of a breadwinner, when he died during the period of receiving the pension or no later than 5 years from the moment when it was stopped receiving it. In terms of their rights, the wives of those who have gone missing during hostilities are equal to the wives of the dead.

In 2022, the provisions of Article 30 of the Law "On pension provision of persons released from military service and certain other persons" were supplemented. They have been updated to reflect the realities of a full-scale invasion. So here the content of the legislation was updated with the necessary wording.

When it comes to the wife's rights to such a pension, it is important that those who did not remarry are mentioned.

What should be emphasized?

Particular attention needs to be emphasized on that part of the legislative norm, which deals with the disabled wife of a serviceman. Disability means reaching the retirement age. This also includes the category of persons with disabilities.

This is not the end of the list of persons mentioned in this legal norm. In the case of a wife, she is also entitled to this pension, regardless of her age or ability to work, if she is caring for the deceased breadwinner's children, grandchildren, brothers or sisters and is therefore unable to work.

The law also states that the Cabinet of Ministers may set other conditions for the appointment of a survivor's pension for the mentioned persons.
