The program is Restoration – conditions, consultation and support of a lawyer when buying an apartment

For more than two years of full-scale war, thousands of Ukrainians lost their homes. That is why the state initiated "eRecovery" - a program aimed at rebuilding lost housing. This program became operational in May 2023. In this article, we will consider in detail the conditions of the state program isRecovery. Who can count on participation in the eRecovery program?

Owners of the following categories of real estate can count on participation in the program:

• One-apartment houses.
• Cottages.
• Apartments and other residential premises in multi-apartment buildings.

However, there is a certain procedure for providing compensation for housing that was damaged as a result of the armed aggression of the Russian Federation. Let's start with such an important stage as the registration of the relevant application. The application can be submitted both in electronic form (through the "Action" relationship) and in paper form - through a notary public, a social protection body, or TsNAP.

Important: the program isRecovery provides compensation only for carrying out repair works of the above-mentioned real estate objects. That is, the apartment or house must be restored with capital or cosmetic repairs. At the same time, the amount of compensation is no more than 200,000 hryvnias (we are talking about compensation for one real estate object that was damaged).

Another important nuance that must be taken into account: you can submit an application under the program isRecovery only until the moment when you start carrying out repair work to eliminate the consequences of the received damage.

If the owner of the damaged property carried out all the repairs themselves and can prove it with receipts, you can also use the eRecovery program with these documents. However, in this case he will not receive compensation. Such cases involve receiving compensation from a special reparation fund.

If the owner has carried out priority repairs (that is, those that have been removed for the purpose of protecting the health and life of persons), he can count on a partial refund of the property to complete its full restoration.

What to do after an application has been submitted under the eRecovery program?

After the successful submission of the application, the next step is consideration of this application by a special Commission.

It is this Commission that determines the amount of compensation. It depends on the following factors:

• Determining the amount of damage to the real estate object.
• Results of inspection of damaged property.
• Availability of photo/video confirmations.

After that, a special checklist in the Register of destroyed/damaged property is filled out in electronic form. The application review period is no more than 30 calendar days. The commission makes a decision on providing compensation or refusing to provide it.

Important: both the decision of the Commission and the amount of compensation can be appealed.

Housing restoration compensation is credited to the card opened by the applicant. Funds can be spent only on the purchase of construction products and repair work. It is forbidden to withdraw funds, transfer them, etc.
