The new law on mobilization: changes in the registration of permanent care

In connection with the fact that on April 16, 2024, the President of Ukraine signed the new law No. 10449 on mobilization training and mobilization, in which the issue was raised on the account of persons who can be engaged in permanent care and at the same time have a reason for postponement of military service.

We remind you: that care on a non-professional basis for a person who needs it is established on the basis of Resolution No. 859 on providing care on a non-professional basis, which has not been amended, and the rules for providing and establishing care have not changed accordingly.

One of the main criteria for establishing care according to the above resolution is:

  • the presence of a medical reason that confirms the need for care;
  • confirmation of family ties;
  • presence of joint registration or joint actual residence at the same address;
  • confirmation of the official income of the person who is a caregiver.

What changes have taken place under the new law:

  • Persons who want to become caregivers must confirm the absence of other persons, or provide relevant certificates or documents confirming why other relatives cannot provide such care for a person who needs it.
  • If care is established over persons of the second or third degree of kinship, such a person must have the 1st or 2nd group of disability.
  • Persons with the 2nd group of disabilities must additionally undergo a medical and advisory commission (MCC), which must confirm the need for such care in the above-mentioned person with a corresponding opinion.

In which cases you may be refused care for a person who needs it:

  • If the person for whom you want to establish care is outside of Ukraine;
  • If such a person has a disability group that is not confirmed on the territory of Ukraine (the document was issued by a medical authority in another country);
  • If the fact of joint residence at the same address is not established with the person for whom care is established.
