The mother is disabled mobilization group 2

Today, in order to exercise the right to postponement under paragraph 11 of Art. 23 of the specified law, it is necessary to confirm that there are no other persons who can support a mother with the II group of disabilities. And this became a real problem in the implementation of this right to postponement, since the law does not specify how this fact should be confirmed. That is, at the level of the law, there is no prescribed algorithm for confirming that there are no other persons, except for conscripts, who can support a mother with the II group of disabilities.

Can they mobilize?

Yes, if the person cannot confirm the fact that he is supporting a mother with the II group of disabilities. Thus, if you have a mother who is a person with a disability of group I or II, then you cannot be mobilized if there is confirmation of the fact of maintenance.

How to get a deferral?

In order to receive a postponement of mobilization, it is necessary to apply to the Territorial center of procurement and social support in which the conscript is registered.

When applying to the Territorial center of procurement and social support, the following documents must be submitted:

• Application for deferment
• A copy of the passport of a citizen of Ukraine and identification code;
• A copy of the MMC certificate that the mother has a disability of the I or II group or a copy of the pension certificate;
• Documents that can confirm the absence of other persons capable of supporting the mother (certificate on the composition of the family, dissolution of the mother's marriage with the father, a notarized statement by the mother that she has no other children.

Accompaniment by a lawyer

It is not mandatory to be accompanied by a lawyer when receiving a postponement of mobilization. However, a lawyer can help you with the following issues:

• Find out what documents are needed to get a deferral.
• Prepare the necessary documents.
• Submit the necessary documents to the military commissariat.
• Appeal the decision of the military commissariat on refusal to issue a deferment.

The cost of the lawyer's support is determined by the agreement of the parties.
