 In recent months, land issues have been actively discussed among citizens. In particular, people are interested: "In whether they will lose their land with the opening of the land market?" After all, for them it is a completely new and unknown procedure that requires detailed study and analysis. In order to fully exercise their legal right to land, it is necessary to understand what the land market means and its impact on every citizen.

 Thus, the land market is the right of citizens to freely buy and sell land. That is, it is an opportunity to be full owners of their lands. For example, a citizen who owns a land plot from July 1, 2020 will be able to sell it freely, without looking for any shadow schemes.

 However, it will be impossible to sell lands that are in state or communal ownership.

 And what about those citizens who do not own land, but only use them on the right of permanent use? How to register the ownership of such land so that in the future it can be freely disposed of?

 Citizens of Ukraine who use land plots of state or communal ownership will be able to privatize them according to the normative-monetary assessment. Mostly, the right to permanent use of land has those citizens who have applied to local governments or public authorities with a request to allocate such land for permanent use or lease and have been using it for several years.

 So, in order not to lose his right to the land which a person uses, it is enough to privatize it. To do this, you should:

  • Apply to the land management organization with an application for the preparation of a land management project;
  • Then register this documentation in the department of the State Geocadastre;
  • After registration in the State Geocadastre, you should apply to the local government with an application for the transfer of land ownership;
  • Having received the decision of the local self-government body on the transfer of land ownership, it is necessary to register the ownership of this land plot. This can be done through the CNAP, a notary or the State Registrar.

 Today, the largest group of people who own land are shareholders. Their land plots are mostly leased. The lease term varies from 3 to 10 years. That is, with the opening of the land market, not everyone can immediately sell their land shares. After all, the term of the agreements will not expire on July 1, 2021. Of course, if the unit owner wants to sell it to his landlord, he will be able to do so by terminating the lease with the consent of the persons. But if the owner of the share has another buyer for this land plot, he will have to wait at least until the expiration of the contract, because it is not so easy to terminate it.

 But there is another option, the land can be sold not to the tenant, but the lease will be valid, and the tenant will pay rent to the new owner.

 It is also worth noting that small farmers are afraid that they can not compete with large agricultural companies, because to buy land that rents from him simply may not have enough money.

 So, there are still plenty of questions, but in order not to lose your right to land, it is necessary to reconsider whether the ownership of it is properly executed, whether the documents for the inherited land are issued, whether it is possible to privatize the land in use.
